Welche Rechte stehen den Bürgerinnen und Bürgern zu, wenn beispielsweise ihre Freiheit nicht gewährleistet wird? Denkt man an den Nationalsozialismus oder andere autoritäre Systeme, erscheint Widersetzen gegen diese Herrschaftssysteme aus heutiger Perspektive unmittelbar in einem positiven Licht. Doch wie verhält es sich in einem modernen demokratischen Rechtsstaat? Wo beginnt und wo endet ein Recht auf Widerstand? Die Untersuchung zielt darauf ab, folgende Forschungsfrage zu beantworten: Inwiefern kann aus der Sicht von Immanuel Kant und John Rawls Widerstand gegen die staatliche Gesetzgebung als legitim angesehen werden? Diese Arbeit wird sich dabei primär auf die Überlegungen von Immanuel Kant und John Rawls beziehen. Diese beiden Autoren wurden aus einer Reihe von Argumenten ausgewählt. Zum Einen vertritt John Rawls selbst die Auffassung, sein Werk würde grundlegend auf den rechtsphilosophischen Annahmen Kants aufbauen und diese weiter ausführen. Dieser Anspruch soll im Rahmen dieser Ausführungen einer Überprüfung unterzogen werden. Darüber hinaus behandeln beide im Kontext ihrer Theorien explizit die Möglichkeiten von Widerstand in Gesellschaften und eignen sich daher hervorragend für einen Vergleich.
