Hobbes’ entire understanding of the state can be regarded as a development series, thus his idea of people and the natural state are important conditions for the later state resulting from it. Only due to this, it becomes understandable why Hobbes designed the state as one with a sovereign leader who has almost unrestricted power. The work refers primarily to the mainwork of Thomas Hobbes: Leviathan. The particularly relevant chapters are chapters 13 and 14. The first part of this work will display Hobbes’ idea of people, the second part will analyse the natural state and the final consideration will critically point out the coherence of the anthropology and natural state and will present my personal opinion.

However these concepts are under pressure from European integration and inner-state cooperation. Utz Schliesky shows the historical development of these concepts which are central to the theory of the state; he proves that their structure is not suited to the multiple levels of the European Union and its members. He outlines a system of common sovereignty and a new concept of plural legitimation so that these concepts may be used for the purpose for which they were created. Utz Schliesky zeichnet die Entwicklung dieser Zentralbegriffe der Staatslehre und des Staatsrechts seit dem Mittelalter nach und uberpruft, inwieweit ihre heutige Fassung geeignet ist, den Herausforderungen durch die europaische Integration und auch durch innerstaatliche Entwicklungen zu genugen. Die in Zeiten des staatsrechtlichen Positivismus und einer anderen Verfassungsordnung am Vorbild des modernen Nationalstaates entwickelten Konzepte fur Souveranitat und Legitimitat sind weder europatauglich noch konnen sie vielfaltige Verzahnungen zwischen Herrschaftstragern und Gesellschaft erklaren. This book addresses fundamental aspects of the concept of public international law in both theory and practice. The argument developed by the author is that, underlying the traditional, horizontal, structure of public international law, a vertical structure of the concept of law may be discerned. This vertical structure is seen unfolding into two, mutually exclusive, frameworks: a framework of obligation, accounting for obligations, and a framework of authorization, accounting for rights. The problem then arising is that a concept of public international law which only admits either rights or obligations cannot be regarded as coherent. The author, however, takes and substantiates the position that coherence can be achieved by suppressing the mutual exclusivity of both frameworks. This move paves the way to formulating the function of public international law in terms of the constituting of international society. Since in public international law the theoretical aspects profoundly affect practice, this book is not only of interest to academics, but also for practitioners, such as officials of foreign offices and international institutions.

The Proceedings present the contributions to the 13th International Kant Congress which was held at the University of Oslo, August 6-9, 2019. The congress, which hosted speakers from more than thirty countries and five continents, was dedicated to the topic of the court of reason.
