Jewish copyright law is a rich body of copyright doctrine and jurisprudence that developed in parallel with Anglo-American and Continental European copyright laws and the printers' privileges that preceded them. Jewish copyright law traces its origins to a dispute adjudicated in 1550, over 150 years before modern copyright law is typically said to have emerged with the Statute of Anne of 1709. It continues to be applied today, notably in a rabbinic ruling outlawing pirated software, issued at Microsoft's request. In 'From Maimonides to Microsoft', Professors Netanel and Nimmer trace the development of Jewish copyright law by relaying the stories of five dramatic disputes, running from the sixteenth century to the present. They describe each dispute in its historical context and examine the rabbinic rulings that sought to resolve it. Remarkably, these disputes address some of the same issues that animate copyright jurisprudence today: Is copyright a property right or a limited regulatory prerogative? What is copyright's rationale? What is its scope? How can copyright be enforced against an infringer who is beyond the applicable legal authority's reach?

Jewish copyright law is a rich body of jurisprudence that developed in parallel with modern copyright laws and the book privileges that preceded them. Jewish copyright law owes its origins to a reprinting ban that the Rome rabbinic court issued for three books of Hebrew grammar in 1518. It continues to be applied today, notably in a rabbinic ruling outlawing pirated software, issued at Microsoft's request. In From Maimonides to Microsoft, Professor Netanel traces the historical development of Jewish copyright law by comparing rabbinic reprinting bans with secular and papal book privileges and by relaying the stories of dramatic disputes among publishers of books of Jewish learning and liturgy.. He describes each dispute in its historical context and examines the rabbinic rulings that sought to resolve it. Remarkably, the rabbinic reprinting bans and copyright rulings address some of the same issues that animate copyright jurisprudence today: Is copyright a property right or just a right to receive fair compensation? How long should copyrights last? What purposes does copyright serve? While Jewish copyright law has borrowed from its secular law counterpart at key junctures, it fashions strikingly different answers to those key questions. The story of Jewish copyright law also intertwines with the history of the Jewish book trade and with steadfast efforts of rabbinic leaders to maintain their authority to regulate that trade in the face of the dramatic erosion of Jewish communal autonomy in the eighteenth and nineteenth centuries. This book will thus be of considerable interest to students of Jewish law and history as well as copyright scholars and practitioners.

When the British Empire enacted copyright law for its colonies and called it colonial, or Imperial, copyright, it had its own interests in mind. Deconstructing the imperial policy regarding copyright offers a startling glimpse into how this law was received in the colonies themselves. Offering the first in-depth study from the point of view of the colonized, this book suggests a general model of Colonial Copyright as it was understood as the intersection of legal transplants, colonial law, and the particular features of copyright, especially authorship. Taking as a case study the story of Mandate Palestine (1917-1948), the book details the untold history of the copyright law that became the basis of Israeli law, and still is the law in the Palestinian Authority. The epitaph on Maimonides's tombstone reads, "From Moses (the prophet) to Moses, there was none like Moses (Maimonides)." The name, "Moses Maimonides" (1138-1204) is an acronym for his Hebraic name Moses ben Maimon). For centuries, yeshiva scholars and students alike affectionately refer to him by the epithet, "the Rambam." Just as the original Moses became the founder of the religion of ancient Israel, Moses Maimonides redefined Judaism for the future generations-more so than any other Judaic thinker or Halakhic scholar who came before or after him. Modern Judaism owes its conceptual and legal foundations to this remarkable thinker. This remarkable person occupies a rare position in the annals of Jewish history and is widely considered as one of the greatest Jewish thinkers and philosophers who ever lived, Maimonides stature reached almost mythic proportions. Jews of all modern religious persuasions-from the ultra-liberal to the Haredi branches of Orthodoxy each claim Maimonides as their patron hero. Both Christian and Islamic thinkers held Maimonides (who refer to him as Musa ibn Maymun in Arabic writings) in high regard. __ I have been impressed with the writings of Rabbi Michael Leo Samuel ever since I read his first book on Philo. I enjoyed the comprehensive nature of his writings and the many insights in his books. I liked that he described Philo's views in an easy to read manner and compared Philo views with those of many ancient and modern writers. Since that time, I wrote six reviews of his Philo books and praised them all. There is much in them that will interest and teach both scholars and readers who had no idea beforehand about this first century philosopher, or just a little information about him. Reading Rabbi Samuel's books will introduce readers to a large number of Philo ideas, those of other thinkers on the ideas, including the Talmuds and Midrashim, and about philosophy and Judaism generally.
