The idea of 'the commons' is a long-standing concept in the English-speaking world and in English law. A similar concept occurs in China. How different from or similar to the English idea of ‘the commons’ is the idea in China; and how is the concept applied? This book explores this important subject. It examines the subject from a philosophical and theoretical perspective; considers ‘the commons’ widely, including tangible commons of resources, intangible commons of culture, identity and social capital, and institutional commons of welfare, security and public goods; and goes on to examine the concept as it applies to the hydropower developments along the Lancang River, outlining the different competing interests of local people, central and provincial government, and environmental considerations. It argues that the concept of ‘the commons’ in China is dual-dimensional, with a vertical dimension of ‘public authority’ and a horizontal dimension of ‘commonly sharing’, that power structures in China have often been flexible and polycentric, and that, correctly applied, this approach will do much to serve the common interest of the people, ensuring positive impacts for shared prosperity for multiple stakeholders, whilst mitigating the negative impacts involved in the delivery of such positive impacts.

The phenomenon of “war brides” from Japan moving to the West has been quite widely discussed, but this book tells the stories of women whose lives followed a rather different path after they married foreign occupiers. During Okinawa’s Occupation by the Allies from 1945 to 1972, many Okinawan women met and had relationships with non-Western men who were stationed in Okinawa as soldiers and base employees. Most of these men were from the Philippines. Zulueta explores the journeys of these women to their husbands’ homeland, their acculturation to their adopted land, and their return to their native Okinawa in their late adult years. Utilizing a life-course approach, she examines how these women crafted their own identities as first-generation migrants or “Issei” in both the country of migration and their natal homeland, their re-integration to Okinawan society, and the role of religion in this regard, as well as their thoughts on end-of-life as returnees. This book offers a comprehensive and detailed analysis of refugee protection in Southeast Asia from an international law perspective. It examines both the legal and policy frameworks pertaining to the protection of refugees in the region as well as the countries’ response to refugee movements from the Indochinese refugee crisis in the mid-1970s to the most recent developments. It covers important aspects of refugee protection, such as access to territory, non-refoulement, the treatment of refugees, the concept of refugee as applied in the region, burden-sharing and durable solutions to the plight of refugees. The analysis focuses specifically on the main countries of asylum within the Association of Southeast Asian Nations that are not parties to the 1951 Refugee Convention, namely Thailand, Malaysia and Indonesia. Using an international law perspective based on the doctrine of the ‘two elements’ (practice and opinio juris), the author argues that these states have long recognized that people fleeing persecution, armed conflict and generalized violence, namely refugees, should be protected. This in turn demonstrates that they recognize the existence and relevance of the international refugee regime despite their refusal to accede to the Refugee Convention.
