What the presence of law tells us about our beliefs, our language, and the world around us In a strikingly original work intended not only for practicing lawyers but for anyone interested in the modern dilemma of the loss of meaning, Joseph Vining invites us to reconsider law as a unique form of thought, inseparably connected to everything in the world that makes up human identity. Oliver Wendell Holmes asserted at the end of the nineteenth century that human law is ultimately a phenomenon in quantitative relations to its causes and effects, and many have been left with an impression of law as a set of processes and rules. Vining takes issue with this and with various reductionist attempts in scientific thought today to express the universe in a single mathematical description of forces, as well as with post-structuralist speculation that there are no valid truth claims, and that human inter-action can be reduced to analysis of power relationships. Law, he argues, is an independent discourse, not reducible to any other, that exists only in human interaction and reflects continuing human worth. Vining's search to reinstate the spiritual dimension in public discourse brings him head-on with a wide array of powerful academic forces: linguistics theory, political science, the new historicism, and the traditional teaching of law. This book consists of a collection of what Vining calls "amplifications" of the implied text of the law—impressions, commentaries, vignettes, poems, and dialogues—which illustrate aspects of conventional legal language and logic, and the subjects legal practice regularly deals with, such as promises, death, and crime. Throughout we see that law reaches deeply into the way we know ourselves and other persons, all of whom speak through law as law connects language to person and person to action. The texts generated by legal method constitute the living record of social acquaintance and contest, speaking across cultures and across centuries. It is the close reading of legal texts and contexts, Vining argues, that provides the present source of the transcendental in modern secular life. But unlike the other academic arts of interpretation, law alone is directly connected with the most real, the most particular and, at the same time, the most universal facts of social life. From Newton's Sleep casts doubt on the certainties past and present and creates new grounds for skepticism and conviction. The fragmentary form of the book mirrors its subject. It is intended to be picked up and read as occasion allows by lawyers and anyone interested in law.

The history and philosophy of scientific ideas and the role poiēsis and imagination play in our understanding of science and progress are widely explored in this book. By examining the views of William Blake and other poets in the context of twentieth-century philosophers Hannah Arendt, Jacob Bronowski, Martin Heidegger, Bruno Latour and Karl Popper, amongst others, the book takes an eclectic approach drawing on examples from biology, history, literature, philosophy and economics, arguing for the reestablishment of imagination as a central attribute of science that may help to resolve some of our most pressing ecological problems as seen in the context of science and technology studies and what is loosely developing into the discipline of environmental humanities. Snow’s debate on the separation of the arts and sciences as alive and well, traces the schism back to Plato but more importantly to the seventeenth century and David Hume’s removal of imagination in the conjunction between our observation of causes and their effects. In "Amazing Grace," the best-loved of all hymns, John Newton's allusions to the drama of his life tell the story of a youth who was a virtual slave in Sierra Leone before ironically becoming a slave trader himself. Liverpool, his home port, was the center of the most colossal, lucrative, and inhumane slave trade the world has ever known. A gradual spiritual awakening transformed Newton into an ardent evangelist and antislavery activist.Influenced by Methodists George Whitefield and John Wesley, Newton became prominent among those favoring a Methodist-style revival in the Church of England. This movement stressed personal conversion, simple worship, emotional enthusiasm, and social justice. While pastor of a poor flock in Olney, he and poet William Cowper produced a hymnal containing such perennial favorites as "Glorious Things of Thee Are Spoken" and "God Moves in a Mysterious Way." Later, while serving a church in London, Newton raised British consciousness on the immorality of the slave trade. The account he gave to Parliament of the atrocities he had witnessed helped William Wilberforce obtain legislation to abolish the slave trade in England.Newton's life story convinced many who are "found" after being "lost" to sing Gospel hymns as they lobbied for civil rights legislation. His close involvement with both capitalism and evangelicalism, the main economic and religious forces of his era, provide a fascinating case study of the relationship of Christians to their social environment. In an afterword on Newtonian Christianity, Phipps explains Newton's critique of Karl Marx's thesis that religious ideals are always the effect of what produces the most profit. Phipps relies on accountsNewton gives in his ship journal, diary, letters, and sermons for this most readable scholarly narrative.
