¿Por qué debería un magistrado español tener jurisdicción sobre un abogado estadounidense acusado de facilitar la tortura en la base de Guantánamo? ¿Qué faculta a un magistrado inglés a firmar una orden de detención de un exdictador chileno? ¿Podría ser legítimo, o moralmente defendible, que un tribunal israelí juzgue a un nazi por crímenes cometidos fuera de Israel y, de hecho, antes de la creación de ese Estado? Este libro brinda el primer tratamiento sistemático de los problemas y desafíos que presenta la jurisdicción penal extraterritorial en el Derecho internacional. La aplicación extraterritorial de normas penales es una práctica arraigada en la mayoría de los sistemas jurídicos del mundo y, en determinados supuestos, un principio firmemente establecido en el Derecho internacional público. Así, en primer lugar, los Estados a menudo reclaman el derecho de castigar determinadas conductas con arreglo a su Derecho interno, aun cuando han sido cometidas fuera de sus fronteras territoriales, por ejemplo, en virtud de la nacionalidad del perpetrador o de su víctima. La aplicación extraterritorial de sanciones penales es asimismo uno de los rasgos definitorios del Derecho penal internacional. Distintos individuos han sido perseguidos penalmente en distintas partes del mundo por crímenes de lesa humanidad, crímenes de guerra, genocidio y otros delitos internacionales ante tribunales que a menudo estaban situados fuera del territorio del Estado en el que tales crímenes se habían cometido. La jurisdicción penal extraterritorial tiene, por último, gran importancia en la respuesta jurídica a nuevas formas de criminalidad globalizada, como el terrorismo transnacional, el tráfico de drogas y la trata de personas. Este libro ofrece una teoría normativa de la jurisdicción penal extraterritorial y de ese modo procura llevar los debates contemporáneos sobre justicia penal en nuevas direcciones, como los desafíos que presenta la globalización, el surgimiento de la criminalidad transnacional, el terrorismo y la guerra. Alejandro Chehtman es profesor investigador de la Escuela de Derecho de la Universidad Di Tella e investigador del Consejo Nacional de Investigaciones Científicas y Técnicas de la Argentina. Sus trabajos de Derecho internacional público, Derecho penal y filosofía del Derecho han sido publicados en importantes revistas internacionales, como Stanford Journal of International Law, Journal of International Criminal Justice, New Criminal Law Review y Law and Philosophy, entre otras. Desde enero de 2014 se desempeña como Marie Curie Fellow en la Facultad de Derecho del University College London, trabajando en una investigación sobre teoría de la guerra justa y Derecho internacional humanitario en conflictos asimétricos. This 2005 book discusses the legitimacy of the international criminal law regime. It explains the development of the system of international criminal law enforcement in historical context, from antiquity through the Nuremberg and Tokyo Trials, to modern-day prosecutions of atrocities in the former Yugoslavia, Rwanda and Sierra Leone. The modern regime of prosecution of international crimes is evaluated with regard to international relations theory. The book then subjects that regime to critique on the basis of legitimacy and the rule of law, in particular selective enforcement, not only in relation to who is prosecuted, but also the definitions of crimes and principles of liability used when people are prosecuted. It concludes that although selective enforcement is not as powerful as a critique of international criminal law as it was previously, the creation of the International Criminal Court may also have narrowed the substantive rules of international criminal law.
