The latter subject has become practically obsolete; the former is, in fact, foreign to the plan of the work. That plan remains substantially the same as before. The progress of a suit in the higher courts of the state is traced, from its origin and preliminaries, down to its final determination; practical directions being given for its conduct and management, in each step which may be necessary or advisable during that progress. The provisions of the Code, of the Revised or General Statutes, and of the Rules of the Courts, which bear upon each particular division of the general subject, are, on the present occasion, cited in the body of the work, instead of being subjoined at its close.
