本書對正當防衛的正當性依據及防衛限度的問題進行了較為詳細的探討。基於Rawls無知之幕的假設，原初狀態中的理性人都會希望設置正當防衛制度來維護自己應當享有的自由權利。正是這種理性人的普遍同意才使正當防衛成為了具有可普遍性的、維護自由權利的正當規則。正當防衛的首要目的在於保護公民個人權益，但是，國家和公共利益等超個人法益作為公民自由權利的前置保障機制，同樣屬正當防衛的保護對象。因此，正當防衛中的個人保護和法秩序維護兩大基本原則均體現了保障公民自由權利的需求，具有共同的根本目的與相同的理論基礎，構成協調統一的整體。根據這種整體性二元論，對於防衛限度的認定，應當貫徹「權利無需向不法讓步」之原則，採納必需說的立場，僅以制止不法侵害的客觀必要性判斷防衛行為是否超出了必要限度，不能再以功利主義的優越利益原則對防衛權進行限制。但是，在防衛行為所損害的法益不成比例地遠超過所保護之法益等情形中，應當對防衛權予以限制。這些對正當防衛的限制仍然是理性人追求自身利益最大化的表現。其只是表面上與「權利無需向不法讓步」之原則相衝突，實際上卻是正當防衛之正當依據的必然要求。 依照本書的這種理論立場，在別無他法的情況下，警察出於營救目的對犯罪份子施加酷刑逼取保護法益所必需之信息的行為（即營救酷刑），也能夠通過正當防衛合法化。雖然在德國法秩序中，由於正當防衛的對立性二元論、對人性尊嚴的絕對保護以及對國際條約的極度親善這三個因素的共同作用，難以得出營救酷刑構成正當防衛的結論。然而，本書所主張的是整體性二元論，中國大陸法秩序在對待人性尊嚴和國際條約的態度上也與美國更為接近，與德國存在明顯的不同。因此，在中國大陸法律體系下，不能簡單依據人性尊嚴或國際條約否定營救酷刑構成正當防衛的可能性。
