El Derecho Internacional evoluciona, aunque es cierto que aunque su aplicación, en un mundo todavía descentralizado, sigue siendo débil, su eficacia es cuestionada. Pareciera todavía, ante la ausencia de órganos superiores que garanticen el cumplimiento de la normativa jurídica internacional, como dice Rodríguez Carrión, que la aplicación de las normas "descansa prioritariamente en el autocumplimiento" . Esta afirmación muestra la debilidad del Derecho Internacional como disciplina reguladora de las relaciones en la sociedad internacional y la constitución de una verdadera comunidad internacional basada en relaciones de solidaridad, aunque estamos seguros que el camino y las nuevas realidades apuntan en esa dirección.No todos los Estados actúan de conformidad con el Derecho Internacional y contribuyen con su eficacia. Algunos Estados, denominados forajidos, desconocen sus compromisos internacionales, ante lo cual la comunidad internacional es cada vez más capaz de adoptar posiciones de distinto tenor, evidentemente, conforme al Derecho Internacional mismo, para hacer que ese Estado se ajuste a las normas y respete sus obligaciones internacionales, en favor de la paz, la seguridad y la estabilidad en las relaciones internacionales.
