This rich collection focuses on the broad research interests of Professor Nico Schrijver, in whose honour it was created. Written by a wide range of international scholars affiliated with Leiden University's Grotius Centre for International Legal Studies, the essays reflect Professor Schrijver's important contribution to academia and practice, particularly in the fields of sovereignty, human rights and sustainable development. The authors aim to reflect on changes in international law and on new developments in the diverse fields they explore. "Furthering frontiers" is the research theme of the Grotius Centre. Its exploration in this thought-provoking volume is a fitting homage to Nico Schrijver's achievements on the occasion of his retirement as Chair of Public International Law of Leiden University.

What role do the people play in defining and developing human rights? This volume explores the very topical issue of the lack of democratic legitimisation of national and international courts and the question of whether rendering the original process of defining human rights more democratic at the national and international level would improve the degree of protection they afford. The authors venture to raise the crucial question: When can a democratic society be considered to be mature enough so as to be trusted to provide its own definition of human rights obligations?

Also available as an e-book In a relatively short time the concept of “sustainable development” has become firmly established in the field of international law. The World Commission on Environment and Development concisely defined sustainable development as follows: “development that meets the needs of the present generation without compromising the ability of future generations to meet their own needs”. This definition takes into account the needs of both the present and future generations as well as the capacity of the earth and its natural resources which by clear implication should not be depleted by a small group of people (in industrialized countries). The aim of this book is threefold : to review the genesis and to clarify the meaning of the concept of sustainable development, as well as to assess its status within public international law. Furthermore, it examines the legal principles that have emerged in the pursuit of sustainable development. Lastly, it assesses to what extent the actual evolution of law demonstrates the balance and integration with all pertinent fields of international law as urged by the Rio, Johannesburg, and World Summit documents. This is the second volume in the Hague Academy of International Law Pocket Book series; it contains the text of the course given at the Hague Academy by Professor Schrijver.

The Future Of International Environmental Law written by David Kenneth Leary and has been published by this book supported file pdf, txt, epub, kindle and other format this book has been release on 2010 with Law categories.

This book explores the future of international environmental law in a world of ever worsening environmental crises. It examines the success stories and failures of international environmental law and argues that future responses to global environmental crises will be more about good environmental governance than just more treaties and laws. Environmental governance will need to accommodate the needs and aspirations of peoples from developed and developing countries alike and will have to be based on decisions and actions by a vast range of actors and stakeholders--not just the nation-state that has traditionally dominated environmental diplomacy. This also suggests a need to be cognizant of the close links to other areas of international law, including human rights. "The Future of International Environmental Law" tackles the major environmental challenges of our times including climate change, biodiversity loss, and polluction and overfishing of the oceans. It examines what we can learn from the implementation of existing international environmental laws over the past few decades. It also considers a range of emerging issues such as the management of the environmental challenges faced by the Arctic, nanotechnology, biofuels and synthetic genomics.

This volume provides an innovative and engaging way of assessing the development of international law scholarship and practice to date and its potential future development by focusing upon the ‘leading works’ of the discipline. International law has established itself as an important area of academic study and legal practice. Given its academic, legal and everyday significance and its prolific role within law school teaching and research, it is important to question and analyse the development of international law, exploring the complex and shifting interplay between law, policy, theory and culture and the role of international and national actors within a diverse and dynamic community of nations. This collection presents contributions from leading scholars of public international law across the globe and the works chosen by the editor represent a diverse range of subjects within the broader discipline. Each chapter analyses the importance and legacy of a specific work, with a view to reflecting upon how that publication has contributed to shaping the broader literature in the field of international law and how it may continue to have an influence on both scholarship and practice in the future. Taken as a whole, the chapters included in this collection provide an original exploration of a variety of important themes about how the discipline has evolved over time. The Prologue and Epilogue critically assess the development of international law in light of the reflections by contributors. The book will be a valuable resource for lawyers, international law practitioners, students, and academics alike.

The Oxford Handbook Of International Environmental Law written by Lavanya Rajamani and has been published by Oxford University Press this book supported file pdf, txt, epub, kindle and other format this book has been release on 2021-08-06 with Law categories.

The second edition of this leading reference work provides a comprehensive discussion of the dynamic and important field of international law concerned with environmental protection. It is edited by globally-recognised international environmental law scholars, Professor Lavanya Rajamani and Professor Jacqueline Peel, and features 67 chapters authored by 76 renowned experts in their fields. The Handbook discusses the key principles underpinning international environmental law, its relevant actors and tools, and rules applying in its substantive sub-fields such as climate law, oceans law, wildlife and biodiversity law, and hazardous substances regulation. It also explores the intersection of international environmental law with other areas of international law, such as those concerned with trade, investment, disaster, migration, armed conflict, intellectual property, energy, and human rights. The Handbook sets its discussion of international environmental law in the broader interdisciplinary context of developments in science, ethics, politics and economics, which inform the way in which environmental rules are made, implemented, and enforced. It provides an introduction to the foundations of international environmental law while also engaging with questions at the frontiers of research, teaching, and practice in the field, including the role of Global South perspectives, the contribution made by Earth jurisprudence, and the growing role of a diverse range of actors from indigenous peoples to business and industry. Like the first edition, this second edition of the Handbook is an essential reference text for all engaged with environmental issues at the international level and the applicable governance and regulatory structures.
