Homosexual marriage is wedlock between persons of same sex. This study examines the current wave of change in the meaning of marriage arising from the trend that emerged consequent to the legalization of homosexuality across some countries of the world. However, Nigeria is one of the countries that have criminalized homosexual behaviour. Hence, this research work seeks to establish whether the law is against human rights of the homosexuals or not by examining the bases for the enactment of the anti-gay law in Nigeria. Nigerian’s conception of the nature and effects of homosexuality, and how they affect the adoption of the same-sex prohibition law; lastly the parameters on which Nigeria’s adoption of the anti-gay marriage law can be seen as violation of human rights. The qualitative and quantitative methods of analysis are used in the course of this study. The study establishes that the social value system and the orientation of the people about sexual orientation do not support the legalization of homosexual marriage.
