This work studies the Great Council of Malines as an institution. It analyzes the Council’s internal organization and staff policy, its position within the broader society of the Austrian Netherlands, the volume and nature of litigation at the Council and its final years and ultimate demise in the late 18th and early 19th century. By means of this institutional study, this volume provides insight into the role played by the Great Council in the process of state-building in the 18th century Austrian Netherlands. While superior courts were once considered to be the prime agencies of change in the Early Modern Period, tools par excellence for the sovereigns’ striving towards centralization and superiority, their position in the 18th century has so far been barely touched upon. This work focuses specifically on the 18th century supreme court of the Austrian Netherlands and provides a broad overview with attention to other aspects of the tribunal's functioning and to its role in 18th century attempts at state formation.

In the course of the early modern period, the capacity of European states to raise finances, wage wars, subject their own and far away populations, and exert bureaucratic power over a variety of areas of social life increased dramatically. Nevertheless, these changes were far less absolute and definitive than the literature on the rise of the "modern state" once held. While war pushed the boundaries of the emerging fiscal military states of the seventeenth and eighteenth centuries, rulers remained highly dependent on negotiations with competing elite groups and the private networks of contractors and financial intermediaries. Attempts to increase control over subjects often resulted in popular resistance, that in their turn set limits to and influenced the direction of the development of state institutions. Written in honour of the leading historian of war and state formation in the early modern Low Countries, Marjolein 't Hart, the chapters gathered in this volume examine the main drivers, beneficiaries and discontents of state formation across and beyond Europe in the early modern period.

De Geldersen stonden in de vijftiende en zestiende eeuw te boek als boers, barbaars, oorlogszuchtig en rebels. Dit imago hadden zij te danken aan de vele oorlogen met de Bourgondische en Habsburgse vorsten, die het hertogdom Gelre wilden veroveren. Gelderse geschiedschrijvers zagen dat anders: zij beschreven hun landgenoten als dapper, sterk, ongekunsteld en vrijheidslievend. Aart Noordzij beschrijft de ontwikkeling van en de relatie tussen de Gelderse politieke gemeenschap en de Gelderse identiteit in de periode 1100-1600. Hij bespreekt achtereenvolgens de Gelderse dynastie, het land en de identiteit. In de verbeelding van Gelre speelden onder andere de naam 'Gelre' een rol, evenals de bloemen en de leeuw in het wapen, lieux de mémoire, dynastieke genealogieën en oorsprongverhalen, de fysieke kenmerken van het land, en de oude Germanen. Een collectief gedeeld Gelre-beeld ontbrak, maar juist daardoor kon de persoonlijke of lokale identiteit gerelateerd worden aan Gelre.

Eerst wordt de bestuurlijke ontwikkeling in Gelre geschetst, waarbij de competentie van het Hof natuurlijk een grote rol speelt. Daarna komt de procesgang aan de orde en de functie die de advocatuur heeft. De civielrechtelijke procedures worden toegelicht met twee boeiende rechtszaken. Prof.dr. F. Keverling Buisman is emeritushoogleraar rechtsgeschiedenis aan de Universiteit van Amsterdam en was lange tijd directeur van het Gelders Archief.
