Amartya Sen und Martha C. Nussbaum haben mit ihren Versionen des „Capability Approach“ eine Möglichkeit dazu geschaffen. Grundlage ihrer Theorien ist die Überzeugung, dass Gleichheit vor allem in Form von Verwirklichungschancen für die einzelnen Individuen („capabilities“) angestrebt werden sollte, nicht durch negative gesetzliche Freiheiten oder die Bereitstellung materieller Güter. Eine der Kernfragen der politischen Philosophie ist, welche Bedeutung Gleichheit für eine gerechte Gesellschaft haben muss. Amartya Sen ist der Meinung, dass eine jede Gerechtigkeitstheorie nach Gleichheit in irgendeiner Form strebt, egal was mit Gleichheit im Einzelnen gemeint ist. Übernehmen wir seine Meinung, dann stellt sich mit ihm die Frage danach, was und wie Gleichheit auszusehen hat. Es lassen sich viele Beispiele finden, in denen gegen oder für Gleichheit in irgendeiner Form argumentiert wurde; in ihnen fallen mitunter Begriffe wie Chancengleichheit, Gleichmacherei, Angleichung oder andere, welche ganz unterschiedliche Bedeutungen einnehmen können. Ziel dieser Arbeit ist, zunächst Sens und Nussbaums „capability“-Ansätze in zusammengefasster Form darzulegen. Dabei soll auf die Vorüberlegungen, den Aufbau und die Implikationen der Ansätze eingegangen werden. Darüber hinaus soll eine, auf der wissenschaftlichen Diskussion der Theorien aufbauende, kritische Betrachtung der Möglichkeiten und Unzulänglichkeiten beider Ansätze geleistet werden. Nach der Beschäftigung mit Sens „capability approach“ und Nussbaums „aristotelian approach“ wird anhand der Werke Nussbaums zu capabilities und der Emanzipation von Frauen untersucht, ob und wie sie die Frage geschlechtsspezifischer Ungleichheit mit ihrem grundsätzlichen Ansatz eines Lebens in Menschenwürde verbindet. Darauf zurückgreifend soll die Frage beantwortet werden, inwiefern sich Nussbaums Theorie zur Analyse geschlechtsspezifischer Ungleichheit eignet.
