Der Begriff der "sozialen Gerechtigkeit" ist in der politischen Alltagsrhetorik längst zu einer Leerformel verkommen. Soll der Ausdruck nicht gänzlich konturlos und damit für die wissenschaftliche Diskussion unbrauchbar werden, ist es erforderlich, ihn auf der Grundlage einer klaren philosophischen Analyse zu reformulieren. Genau das hat der amerikanische Philosoph John Rawls (1921-2002) mit seiner "Theorie der Gerechtigkeit" von 1971 versucht. Sein Modell der "Gerechtigkeit als Fairness" will das liberale Erbe der amerikanischen Tradition um eine soziale Komponente erweitern und zu einem liberalen Egalitarismus ausbauen. Um die Frage zu beantworten, ob und inwiefern diese Konzeption anschlussfähig für die katholische Soziallehre ist, wird in der vorliegenden Studie zunächst die Genese der Rawls'schen Theorie und dann das lehramtliche Verständnis sozialer Gerechtigkeit kritisch rekonstruiert. Vergleicht man beide Konzepte nach ihren jeweils wichtigsten philosophischen Eckdaten, dann zeigt sich, dass Rawls' Theorie zwar von ihrem begründungstheoretischen Ansatz, nicht aber von ihrer inhaltlichen Feinstruktur her mit dem lehramtlichen Gerechtigkeitsverständnis zum Ausgleich zu bringen ist.

Deconstructive Constitutionalism explores the relationship between the thinking of Immanuel Kant and Jacques Derrida concerning modern constitutionalism. Kant is widely recognized as one of the philosophical forebears of modern constitutionalism; that is, the notion that state powers should be defined and limited through a constitution. A new reading of justice engaging the work of two philosophical poets who stand in conversation with the work of Martin Heidegger. What is the measure of ethics? What is the measure of justice? And how do we come to measure the immeasurability of these questions? Thinking the Poetic Measure of Justice situates the problem of justice in the interdisciplinary space between philosophy and poetry in an effort to explore the sources of ethical life in a new way. Charles Bambach engages the works of two philosophical poets who stand as the bookends of modernity—Friedrich Hölderlin (1770–1843) and Paul Celan (1920–1970)—offering close textual readings of poems from each that define and express some of the crucial problems of German philosophical thought in the twentieth century: tensions between the native and the foreign, the proper and the strange, the self and the other. At the center of this philosophical conversation between Hölderlin and Celan, Bambach places the work of Martin Heidegger to rethink the question of justice in a nonlegal, nonmoral register by understanding it in terms of poetic measure. Focusing on Hölderlin’s and Heidegger’s readings of pre-Socratic philosophy and Greek tragedy, as well as on Celan’s reading of Kabbalah, he frames the problem of poetic justice against the trauma of German destruction in the twentieth century.

Jacques Derrida: Law as Absolute Hospitality presents a comprehensive account and understanding of Derrida’s approach to law and justice. Through a detailed reading of Derrida’s texts, Jacques de Ville contends that it is only by way of Derrida's deconstruction of the metaphysics of presence, and specifically in relation to the texts of Husserl, Levinas, Freud and Heidegger - that the reasoning behind his elusive works on law and justice can be grasped. Through detailed readings of texts such as To speculate – on Freud, Adieu, Declarations of Independence, Before the Law, Cogito and the history of madness, Given Time, Force of Law and Specters of Marx, De Ville contends that there is a continuity in Derrida’s thinking, and rejects the idea of an ‘ethical turn’. Derrida is shown to be neither a postmodernist nor a political liberal, but a radical revolutionary. De Ville also controversially contends that justice in Derrida’s thinking must be radically distinguished from Levinas’s reflections on ‘the other’. It is the notion of absolute hospitality - which Derrida derives from Levinas, but radically transforms - that provides the basis of this argument.
