English summary: Unlike Anglo-American law, German criminal procedure is not structured as a procedure based on party prosecution. In the main trial, the principle of ex officio judicial investigation still applies, even if this also requires an accusation. Volker Haas deals with the historical reasons for the inconsistencies in this procedure. He focuses on the influence of the constitutional monarchy and the theory of punishment on the reform of criminal procedure in the 19th century. Since these historical reasons no longer apply today, the author concludes his work with a discussion of the consequences of this change in the law. German description: Der deutsche Strafprozess zeichnet sich durch die Besonderheit aus, dass zwar das Verfahren durch die Anklageerhebung der Staatsanwaltschaft als Strafverfolgungsorgan in das Stadium der Hauptverhandlung gelangt, dass es aber nach ihrer Eroffnung Aufgabe des Gerichts ist, den Sachverhalt von Amts wegen zu ermitteln. Bei der Festsetzung der Strafe unterliegt es keinen Bindungen an die Antrage der anderen Prozessbeteiligten. Die Staatsanwaltschaft kann daher die Anklage in der Hauptverhandlung nicht rechtswirksam vertreten und ubt somit in diesem Verfahrensabschnitt lediglich die Rolle eines Gesetzeswachters aus. Die daher nicht zu leugnende Tatsache, dass das reformierte Strafverfahren die Inquisitionsmaxime nicht vollstandig uberwunden hat, beruht historisch zum einen auf einem fortwirkenden quasi-absolutistischen Souveranitatsverstandnis, mit dem ein wirklicher Rechtsstreit zwischen Untertan und Staat sowie wirkliche Kontrolle der Exekutive durch Gerichte als unbeteiligte Dritte nicht zu vereinbaren gewesen ware. Zum anderen wurde der Strafrichter wiederum als Sachwalter einer sittlich oder sogar religios begrundeten absoluten Strafgerechtigkeit qualifiziert. Da beide Grunde heute unter der Herrschaft des Grundgesetzes ihre Gultigkeit verloren haben, untersucht Volker Haas abschliessend, ob nicht die Hauptverhandlung als Parteiprozess ausgestaltet werden musste, in dem der Staat sein Strafrecht gegenuber dem Angeklagten, der Angeklagte aber auch seine subjektiven Grundrechte gegenuber dem Staat vor einem neutralen Gericht durchsetzen kann.
