Die Regulierung des Netzausbaus im Energiesektor ist vor allem aufgrund von Maßnahmen im Zusammenhang mit der Energiewende von einem starken Wandel geprägt. Zur Integration regenerativer Energieträger in die Stromversorgung waren und sind erhebliche Anpassungen des Stromversorgungssystems notwendig. So erfuhr das Energiewirtschaftsgesetz (EnWG) in den letzten acht Jahren zahlreiche Änderungen und wurde im Bereich des Netzausbaus um mehr als 30 Paragraphen ergänzt. Flankiert wurden diese Änderungen von der Einführung des Gesetzes über den Bundesbedarfsplan (BBPlG), des Gesetzes zum Ausbau von Energieleitungen (EnLAG) und des Netzausbaubeschleunigungsgesetzes Übertragungsnetz (NABEG). Die Dimension der Änderungen des Netzausbaurechts und insbesondere des EnWG ist somit erheblich. Diese Situation zwingt den Rechtsanwender dazu, sich das geltende – bzw. das für die Beurteilung eines bestimmten Falles maßgebliche – Recht im Einzelnen erst zu erschließen. Auch bei der Heranziehung der Spruchpraxis der Gerichte sowie der mittlerweile reichhaltigen wissenschaftlichen Literatur ist stets zu prüfen, ob und inwieweit sich die dort relevanten Rechtsgrundlagen geändert haben. Diese praktischen Notwendigkeiten greift der vorliegende Band auf, indem die Entwicklung des BBPlG, des EnLAG, des NABEG und der für den Netzausbau relevanten Vorschriften des EnWG nachgezeichnet und leicht nachvollziehbar dargestellt wird. Durch die Darstellung gewinnt der Leser zügig die Übersicht über die maßgeblichen Normen des Netzausbaurechts. Das vorliegende Werk dient insoweit auch dem Zugang zum Verständnis der sich stark gewandelten und teilweise komplexen Vorschriften.
