The succession law of Ghana has undergone enormous change since the enactment of the Wills Act, 1971. Relevant literature has hardly kept pace with changes in statutory and judge-made law. The need for a comprehensive statement of the pertinent law has made itself felt for quite a long time. In response, several eminent jurists have grappled with some of the major problems associated with succession. The present account seeks to provide a detailed assessment, analysis, evaluation and critique of the law of wills of Ghana.A substantial number of the ideas put forward here originated from my experience with students in the Faculty of Law, University of Ghana. Tutorial sessions sparked off brilliant new angles for discussion and opened many new vistas for analysis.Basically founded upon analysis of the Wills Act, 1971 of Ghana and relevant English principles, the discussion here also traverses a wider field. The end result is an opus that interweaves essentially English concepts of the law of wills with equivalent Ghanaian developments. The topics for discussion are broadened to include indigenous forms of testation. The book is broken into appropriate divisions and subdivisions to facilitate fuller discussion of each topic, largely along conventional formats for the analysis of the law of wills. The underlying theme is concerned with the devolution of a person's assets upon death. Both the substantive and procedural laws are considered in some detail and on the basis of consistent principles of law. Various types of wills and rules for the making and revocation of wills as well as laws dealing with privileged wills, incorporation of documents, revival and republication, legacies and the construction of wills are analysed extensively with a view to encapsulating the corpus of the law of wills.

Modern law of succession in Ghana offers an authoritative exposition, penetrating analysis and a stimulating critique of the current law of succession in Ghana with suggestions for reform. This book covers both testate and intestate succession. A considerable portion of the book is devoted to the law of wills, a subject in respect of which there has hitherto been a notable dearth of legal literature in Ghana. The Wills Act of Ghana is subjected to an interpretation and appraisal and contrasted with the old rules under the English Wills Act, 1837. Customary law wills are also discussed in the light of the recent judicial pronouncements on the essential requirements. The new Interstate Succession Law is analysed in detail with attention to the important innovations and the myriad of problems in its train. Intestacy and its responsibilities under the customary law are discussed in the context of the statutory changes.

About the book Law relating to Wills has evoked curiosity amongst Judges, lawyers and law students alike. This book offers exhaustive commentary on principles governing this law and illustrates them with contemporary case laws. The book does not contain many judicial authorities of colonial period which have lost relevance in current times, but it does examine the relevant pronouncements. The book discusses concepts which are fundamental to exercise of testamentary jurisdiction, in detail which often engages courts. Four chapters elaborate on law relating to execution and proof of Will. Three chapters are devoted to discussing law relating to grant of probate and letters of administration. Concept of revocation of Will and revocation of probate and letters of administration has been discussed in one chapter each. Other aspects of law, which do not much invite much attention of courts like construction of Will, jurisdiction of court, powers and duties of executors and administrators, void bequest, vesting of legacy, contingent bequest, conditional bequest etc. have also received their due share in the book. Authors have discussed novel concepts like 'Living Will' in this book.
