This book discusses current theories and practices in the field of public procurement. Over the past few decades, public procurement has had to evolve conceptually and organizationally in the face of unrelenting budget constraints, government downsizing, public demand for increased transparency in public procurement, as well as greater concerns about efficiency, fairness and equity. Alexander Rhode investigates performance-oriented measures of Contracting Authorities in public tenders conducted within the EU. He finds that Contracting Authorities can improve their performance and attract more suppliers by publishing (as precise as possible) starting prices in the beginning of a tender. First, he reports that compared with private-sector negotiations, starting prices do not create entry barriers in public procurement. Second, he finds that increased numerical precision of starting prices is linearly correlated with better performance and a higher number of bids. In public procurement, suppliers tend to attribute increased credibility to precise starting prices which reduces their (perceived) entry risks.

This book examines infringements of competition law in public procurement settings, evaluating the latest European Procurement Directive 2014/24/EU to examine to what extent its provisions facilitate or deter collusion during specific award procedures. Public contracts account for a significant proportion of EU expenditure. It is important to ensure that public contracts are awarded in an open, fair and transparent manner that enables domestic and non-domestic firms to compete on an equal basis, with the aim of improving the quality and lowering the price of purchases made by public authorities. This book assesses the competition law enforcement mechanisms that competition regulators bring to the area of public procurement in the attempt to deter bid rigging. It analyzes key tools for the public and private enforcement of competition law in the domain of public contracts, such as the leniency programme, damages claims for bid rigging and the whistle blower programme. The book uses auction theory as benchmark to assess the risk of collusion in the context of procurement procedures and techniques. Offering a holistic analysis informed by research, it makes recommendations for better design, set up and management of public tenders without distorting competition. Highlighting the need to make use of competition law enforcement mechanisms in the battle against collusion in public procurement, it identifies ways in which the procurement process can be improved, to reduce and prevent bid rigging. This book offers a defense acquisition perspective that provides action orientations and decision making to increase the value-for-money (VFM) of public-private partnerships (PPPs) through public-private stewardship (PPS). The differing motives of the public and the private sector are not conducive to partnership that leads to optimal outcomes. PPS is offered to practitioners and academics as a solution to failures of PPPs by following the public stewardship tenets of fiduciary responsibility and advancing the public interest while factoring in the additional elements of the private sector. The public values of transparency, accountability, responsibility, responsiveness, efficiency, effectiveness, equity, diversity, inclusion, fairness, and security, among others, can be shared in success between the public and private partners. By establishing shared values aligning with each stakeholder’s measures for success, it is possible to devise value propositions for stakeholder decision making that supports inter-organizational strategy, operations, tactics, goals, and objectives. PPS practices can further ensue as the public-private steward utilizes tools of expertise and organizational capacity. The book provides seven portraits of practitioners in the practice of PPS to assist PPP stakeholders achieve VFM.
