Increasing economic competition combined with the powerful threat of transnational activism are pushing firms to develop new political strategies. Over the past decade a growing number of corporations have adopted policies of industry self-regulation—corporate codes of conduct, social and environmental standards, and auditing and monitoring systems. A Public Role for the Private Sector explores the phenomenon of industry self-regulation through three different cases—environment, labor, and information privacy—where corporate leaders appear to be converging on industry self-regulation as the appropriate response to competing pressures. Political and economic risks, reputational effects, and learning within the business community all influence the adoption of a self-regulatory strategy, but there are wide variations in the strength and character of it across industries and issue areas. Recently, multinational corporations have begun to reinvent themselves as socially responsible actors, largely in response to anti-corporate activist pressure. The author argues that a concern with corporate reputation is leading to an ideational shift in corporate behaviour – in essence, it is disciplining their behaviour. As companies 'go global' they increasingly use factories and facilities spread across the world. But who regulates their activities in far flung corners of the world economy? In many sectors such as textiles and apparel, chemicals, and forestry, the answer is that companies regulate their own behaviour through codes and standards which they agree among themselves. The recent growth in corporate self-regulation of labour, environmental and financial practices has attracted the attention of scholars who have detailed the number and content of self-regulatory efforts in various sectors. Missing so far, however, has been an analysis of the effectiveness and impact of self-regulation. Does self-regulation actually work and under what conditions is it most likely to be effective? The answer to this question is particularly important for developing countries where corporate self-regulation is often seen as substitute for weak governance structures. The chapters in this volume evaluate the effectiveness of self-regulation compared to other forms of global regulation. Across sectors and states, corporate self-regulation works best when those who are regulated have a voice in deciding the content of codes and standards and when some mechanism of compliance exists at the level of the state. Unfortunately, opportunities for voice and state capacity for regulation are often lacking in developing countries. Given this, the book suggests some minimal forms of government action and participation by global actors that can make global corporate self-regulation more effective in bettering conditions in the developing world.

Critics assert that globalization is detrimental to the environment because it encourages location of polluting industries to countries with low environmental regulations. We suggest that globalization might also have positive environmental effects because global ties increase self-regulation pressures on firms in low-regulation countries. Using survey data from firms in China we find that multinational ownership, multinational customers, and exports to developed countries increase self-regulation of environmental performance.

With the globalisation of markets, the phenomenon of market failure has also been globalised. Against the backdrop of the territoriality of nation state jurisdictions and the slow progress of international law based on the principle of sovereignty this poses a serious challenge. However while the legal infrastructure of globalised markets has a firm basis in formal national and international law, the side effects of economic transactions on public goods such as the environment, human health and consumer interests often escape state-based regulation. Therefore, attention is drawn to the potential of self-regulation by transnational industry. While hypotheses abound which try to grasp this phenomenon in conceptual terms, both empirical and legal research is still underdeveloped. This volume helps to fill this gap, in two ways: firstly by reconstructing self-regulatory settings such as multinational corporations, transnational production networks and industry-NGO partnerships in terms of organisation, problem-solving and legitimation, and secondly, by linking their empirical findings to formal law by examining how legal concepts are reflected in self-regulation, how the law builds on self-regulatory solutions, and how it helps to establish favorable conditions for private governance.

Globalization has altered in significant ways the tools available to regulate international commerce. The beginning of the 21st century is characterized by fundamental societal changes: in addition to changing demographics and the globalization of economic flows, the transformation of an industrial-Fordistic society to a non-industrial service society is significant. For more than twenty years, these large-scale trends and their inherent chances and risks have been the topic of vivid discussions in all the social sciences. Keywords are ‘risk-society’, ‘post-industrial society’, ‘knowledge-society’ and ‘information-society’. The implications of these developments are also reflected in the challenge to the traditional, hegemonic and rational understanding of subjectivity. Against the background of these great social changes, several factors indicate that the forms of self-regulation or self-governance are also being transformed. A one-sided consideration of the homo economicus and its varieties would underestimate, for example, certain non-rational forms of self-perception and self-reflection, as well as non-rational practices of self-management and subjectivation. The aim of this anthology is to discuss the question, to what extent the relationship to oneself (its regulation with respect to its governance) and the relationship towards others in (post-)modern societies are being transformed. The perspective of Norbert Elias’ process sociology as well as Michel Foucault’s post-structural theory seem especially promising, as they appear to have been the first researchers consistently and convincingly analysing the ‘nature’ of the individual by reflecting upon its long-term historical process of transformation. Both have different visions but similar concerns: they deal with structures of control that exist within society and within the individual.
