How does the globalization of law, the emergence of multiple and shifting venues of legal accountability, enhance or evade the fulfillment of international human rights? Alison Brysk’s edited volume aims to assess the institutional and political factors that determine the influence of the globalization of law on the realization of human rights. The globalization of law has the potential to move the international human rights regime from the generation of norms to the fulfillment of rights, through direct enforcement, reshaping state policy, granting access to civil society, and global governance of transnational forces. In this volume, an international and interdisciplinary team of scholars explores the development of new norms, mechanisms, and practices of international legal accountability for human rights abuse, and tests their power in a series of "hard cases." The studies find that new norms and mechanisms have been surprisingly effective globally, in terms of treaty adherence, international courts, regime change, and even the diffusion of citizenship rights, but this effect is conditioned by regional and domestic structures of influence and access. However, law has a more mixed impact on abuses in Mexico, Israel-Palestine and India. Brysk concludes that the globalization of law is transforming sovereignty and fostering the shift from norms to fulfillment, but that peripheral states and domains often remain beyond the reach of this transformation. Theoretically framed, but comprised of empirical case material, this edited volume will be useful for both graduate students and academics in law, political science, human rights, international relations, global and international studies, and law and society.

Global Justice and Social Conflict offers a ground-breaking historical and theoretical reappraisal of the ideas that underpin and sustain the global liberal order, international law and neoliberal rationality. For some, this development has been directed by a vision of ‘global justice’. Yet, for many, the world has been marked by a history and continued experience of injustice, inequality, indignity, insecurity, poverty and war – a reality in which attempts to realise an idea of justice cannot be detached from acts of violence and widespread social conflict. In this book Tarik Kochi argues that to think seriously about global justice we need to understand how both liberalism and neoliberalism have pushed aside rival ideas of social and economic justice in the name of private property, individualistic rights, state security and capitalist ‘free’ markets. The relationship between international order and justice has long been central to the study and practice of international relations. For most of the twentieth century, states and international society gave priority to a view of order that focused on the minimum conditions for coexistence in a pluralist, conflictual world. Justice was seen either as secondary or sometimes even as a challenge to order. Recent developments have forced a reassessment of this position. Firstly, many trends in the 1990s increased expectations of greater justice within a liberal and liberalizing international order - for example, in relation to human rights, humanitarian intervention, collective security, and self-determination. Second, globalization deepened the sense of ideational and material interdependence, prompting acknowledgement that we co-exist in a single world and that effective solutions to shared problems cannot be achieved without a concern for justice - especially as the negative aspects of globalization have become more evident. Third, claims to justice and critiques of the existing order have been forcefully pressed by an increasing range of non-governmental and other groups within transnational civil society. These three developments suggest movement towards a greater solidarist consciousness and ambition, based primarily on a liberal vision of the relationship between order and justice. This book sets current concerns within a broad historical and theoretical context; explores the depth and scope of this presumed solidarism amidst the difficulties of acting on the basis of a more strongly articulated liberal position; and underscores the complexity and abiding tensions inherent in the relationship between order and justice. Chapters examine a wide range of state and transnational perspectives on order and justice, including those from China, India, Russia, the United States, and the Islamic world. Other chapters investigate how the order-justice relationship is mediated within major international institutions, including the United Nations, the World Trade Organization and the global financial institutions.

Justice Beyond Borders examines which political principles should govern global politics. It explores the ethical issues that arise at the global level and addresses questions such as: Are there universal values? If so, what are they? What human rights, if any, are there? Are there global principles of distributive justice? Should there be a system of supra-state institutions? Is national self-determination defensible? When, if ever, may political regimes wage war? Is humanitarian intervention justified? Justice Beyond Borders outlines and defends an egalitarian liberal brand of cosmopolitanism to address these questions. It maintains that there are universal principles. It argues, moreover, that these include universal civil and political human rights. It also defends the application of global principles of distributive justice. On this basis, it argues for a system of supra-state political institutions to further promote these universal principles of justice. Having set out principles of ideal theory, it then examines what principles should apply when injustices are committed. To do this it examines when political regimes may wage war and when they may engage in intervention. It thereby draws on cosmopolitan principles to derive and defend a cosmopolitan conception of just war and humanitarian intervention. To arrive at these conclusions, Justice Beyond Borders engages in a sustained analysis of the competing arguments on all the above issues, examining the arguments of nationalists, realists, and those who affirm the ideal of a society of states. It does so by exploring and integrating the work of philosophers, political theorists, and international relations scholars.
