This major new study examines the developing practice of universal jurisdiction, as well as the broader phenomenon of "globalizing" justice, and its ramifications. With a detailed overview of the contemporary practice of universal jurisdiction, it discerns three trends at work: pure universal jurisdiction, universal jurisdiction "plus", and non-use. It also argues that these disparities in practice should raise serious concerns as to the legitimacy and perceived legitimacy of such globalized justice. It then turns to a further consideration, that of globalized justice, precisely because it takes place far from the locus of the crime, and is therefore "externalized" and may fail to achieve many of its putative goals. In addition, this is a key assessment of civil accountability, through the use of the Alien Tort Claims Act in the United States. It details how the use of civil penalties may offer new avenues for redress, particularly with relation to group accountability, whether that of armed groups or of corporations. However, it balances this approach to accountability with recognition of certain flaws within externalized criminal accountability. This study also focuses on mixed tribunals, or other methods of internationalized justice as viable alternatives, which may avoid some of the problems with external justice, but are themselves far from perfect. Mixed or hybrid tribunals in East Timor and Sierra Leone represent different models of hybrid justice and provide the reader with excellent examples of these new forms of justice in action. This book will be of great interest to all students and scholars of human rights international law and political science.

The International Criminal Court was established in 2002 to prosecute war crimes, crimes against humanity, and genocide. At its genesis the ICC was expected to help prevent atrocities from arising or escalating by ending the impunity of leaders and administering punishment for the commission of international crimes. More than a decade later, the ICC’s ability to achieve these broad aims has been questioned, as the ICC has reached only two guilty verdicts. In addition, some of the world’s major powers, including the United States, Russia and China, are not members of the ICC. These issues underscore a gap between the ideals of prevention and deterrence and the reality of the ICC’s functioning. This book explores the gaps, schisms, and contradictions that are increasingly defining the International Criminal Court, moving beyond existing legal, international relations, and political accounts of the ICC to analyse the Court from a criminological standpoint. By exploring the way different actors engage with the ICC and viewing the Court through the framework of late modernity, the book considers how gaps between rhetoric and reality arise in the work of the ICC. What can be done to combat genocide, ethnic cleansing, and other crimes against humanity? Why aren't current measures more effective? Is there hope for the future? Millions of people, particularly in Africa, face daily the prospect of death at the hands of state or state-linked forces. Although officially both the United Nations and the African Union have adopted "Responsibility to Protect" (R2P) principles, atrocities continue. The tenets of R2P, recently cited in a UN Outcomes Document, make it clear that states have a primary responsibility to protect their citizens from genocide, war crimes, ethnic cleansing, and crimes against humanity. When states cannot—or will not—protect their citizens, however, the international community must step into the breach. Analyzing the International Criminal Court's first cases, this work examines the ICCâe(tm)s potential to contribute to truth telling in the aftermath of mass atrocities. The book assesses whether ICC proceedings altogether can serve the victim's right to truth better than thus far acknowledged, and provides insight on why this has not yet been the case. In an innovative and thought provoking manner, the work goes beyond legalistic definitions of the notion of truth towards more traditional transitional justice narratives, breaking down the concept of truth according to the framework provided by the South African Truth and Reconciliation Commissions (SATRC). Specifically, the book analyzes whether and to what extend ICC court proceedings are a viable tool for addressing factual or forensic aspects of the truth, narrative and personal truths, social and dialogue truths, and healing and restorative truths that the SATRC considers essential. In particular, the book argues that of all international crimes tribunals, the ICC is more adept than other courts in serving the truth as thus defined. In exposing this argument, the book looks at both procedural and substantive elements of ICC proceedings, and elaborates on how these elements interplay to create a narrative of mass atrocity events. The study uses the proceedings related to the Democratic Republic of the Congo situation as a test for ICC narrativesâe(tm) viability to contribute to truth telling and fact-finding in the Ituri region.
