This book argues for the utility of human rights in the practice of ocean governance. Maritime spatial planning (MSP) has become the dominant marine management paradigm, with MSP frameworks already at various stages of elaboration and implementation in more than half of all coastal states. However, as experience with MSP accrues, a central systemic shortcoming has become apparent, insofar as the normative frameworks that underpin MSP tend to be grounded in a rationalistic and economistic worldview. The result is a post-political, neoliberal approach to the implementation of MSP, which favours technocratic ‘fixes’ to complex societal problems over efforts to address underlying issues of power and inequality. Building upon the new field of critical MSP studies, this book offers a much-neglected legal contribution. More specifically, it analyses the extent to which law, and particularly human rights law, can be utilised to meaningfully challenge the unjust patterns of human-ocean interaction that MSP preserves or creates, and so provide a vehicle for the formulation and realisation of transformative blue futures. The book looks to human rights as norms that are uniquely capable of bringing into relief the values, cause-and-effect relationships, and uncertainties that prevailing capitalist-industrial framings of the ocean tend to downplay or, worse, disregard. And so, from a more pragmatic viewpoint, the book argues that the policy and advocacy tools associated with human rights can be used within MSP processes to foster patterns of human-ocean interaction which are more conducive to social and environmental justice. This book will be of interest to legal and planning scholars, geographers, and others concerned with ocean governance and the ‘blue turn’ in the social sciences and humanities more generally.

This book offers a comprehensive account of the status and dynamics of people participating in the small-scale fisheries (SSF) of Europe. It covers the situation of SSF in 25 coastal countries, thereby providing a portrait of almost every coastal country on the continent and analyzing the recent evolution of the sector. Small-scale fisheries are argued to be extremely important in Europe, as they provide employment and welfare, while increasing food sovereignty and maintaining communities in coastal areas. The recent worldwide focus on SSF derives from their environmental sustainability, which distinguishes many of their activities from those of large-scale fisheries. This book analyses the diversity of SSF and shows how fishing communities have sometimes developed successful governing models, demonstrating social and economic resilience. While the book emphasizes the strengths of SSF and the synergies that occur with other marine sectors, it also presents cases of failure, in which collective action and policy have actually contributed to a weakening of the sector. In this context, the book shows how governmental policies toward SSF vary considerably from country to country, in a way that is not entirely consistent with European policies.

This thesis explores the avenues for the ecosystem approach to management in the Baltic Sea Region. This region is one of the most contaminated water bodies in the world, although the first Regional Seas Convention was created here and theregion has a long history of cooperation and environmental protection. The current environmental governance arrangements are examined with specific focuson governance structures, cross-sectoral integration and ecological boundaries.The ecosystem approach to management as both a tool and vision of holistic management of natural resources is traced through the evolution of environmental governance, as well as its manifestation in contemporary environmental policies in the region. It is found that the major EU directives, as well as HELCOM polices, promote the ecosystem approach and that its presence has increased inrecent years; it is now the major guiding principle in European marine governance. However, the governance structures impede implementation indifferent ways. The environmental problem areas in the region all require different governance arrangements, thus obstructing a holistic approach. The environmental problems per se also affect each other, necessitating far-reaching sectoral integration and cross-border cooperation, which at present is the major obstacle regarding implementation. The contemporary trends combining solid regionalisation through HELCOM with increased Europeanisation and macro regionalisation by different EU initiatives offer some promise, but the cross sectoral impediments must be resolved if the ecosystem approach is to become apractical approach and not just a policy principle.
