The Committee welcomes the Government's intentions to simplify and streamline legislation on discrimination into one single Equality Bill. But it believes that disability discrimination requires a difference in approach and should be predicated on the idea that we need to treat people differently to accord disabled people equal opportunities. The challenge is to bring disability discrimination law within that broad family of equality law whilst recognising those key differences. To meet this objective, the Government should re-establish the version of disability-related discrimination that existed before the recent Lewisham v Malcolm judgment and which was well understood by employers and employees alike. Preserving strong disability rights needs to go hand in hand with an adequate defence for those with duties under the legislation. Harmonising the different provisions that currently permit employers, service providers, landlords and others to justify disability discrimination in certain circumstances will ensure a balance between their responsibilities and the rights of the disabled person. The Committee also calls for removal of one of the greatest obstacles to improving employment opportunities for older people: the continued existence of the statutory default retirement age in the Employment Equality (Age) Regulations 2006. The overall employment rate of disabled people has increased since 1995, but the rate for people with mental illness, phobias or panic has remained substantially lower (at just over 10 per cent) than that for those with most other types of impairment. Too many employers and disabled people are unaware of what support is available for them through the Access to Work scheme. DWP research identified recruitment as the most common source of discrimination against disabled people but few cases reach court. The public sector has an important role to play in promoting equality but needs to focus on outcomes not process.

NHS Primary Care Trusts (PCTs) were created in 2002 to commission health services for their local populations, and are currently responsible for controlling about 80 per cent of the £76 billion NHS annual budget. In addition, PCTs have responsibility for public health, and many also provide community-based health services such as district nursing and community hospitals. The Committee's report examines the Government's proposals (set out in the Department of Health paper 'Commissioning a Patient-led NHS' published in July 2005, which can be downloaded at http://www.dh.gov.uk/assetRoot/04/11/67/17/04116717.pdf) to cut the number of PCTs and to contract out community health services by the end of 2008. The report raises a number of serious concerns about the proposals, including in relation to: failings in the consultation process; the impact of PCT restructuring and divestment of provider services; and the likelihood that the estimated financial savings of £250 million will be achieved.

The World Bank is a major provider of development funding, analysis and advice. The Bank is not perfect, however, and the context in which it operates continues to change. As a major shareholder and contributor to the World Bank, the UK has a distinct leadership role. The UK should articulate and pursue a vision for reform of the Bank. The Department for International Development's (DFID) and the Bank both have core objectives of poverty reduction. There is an increased responsibility on DFID to ensure that the Bank is organisationally effective and achieving a level of development impact that justifies the UK contributions. More consistent and transparent use of impact assessments by the World Bank across all of its lending is the single most important change in Bank practice that DFID should be pursuing. There should be more representation of developing countries in World Bank decision-making. Selection of the President of the World Bank, should be transparent and on merit, rather than in the gift of the United States. Other recommendations cover: women's empowerment; DFID staffing in relation to the Bank; and climate change. This last is an acute challenge for developing countries. As a development leader, the Bank should use its substantial resources and leverage to support viable renewable energy sources. But the urgency of climate change does not lessen the blight of poverty and the Bank's primary focus must remain on poverty reduction and development.
