(Meus) Grandes Temas da AtualidadeEste livro é composto de vinte temas selecionados: são os meus grandes temas da atualidade. A "Pandemia de COVID-19" é o primeiro: recolhi textos curtos escritos sobre o assunto ao longo de 2020, com o registro de momentos significativos da tragédia. Depois vem "Aquecimento x resfriamento global". Aqui, valho-me de uma entrevista dada pelo professor Ricardo Augusto Felício (professor de Climatologia da USP) a Jô Soares ("Programa do Jô", extinto programa de entrevistas da Rede Globo), e de uma palestra intitulada "A Verdade sobre a Amazônia" ministrada em 5/10/2019 em Roma/Itália pelo professor Luiz Carlos Baldicero Molion (UFAL) durante o Sínodo de Bispos da Pan-Amazônica. O texto contido no livro consiste de resumo da entrevista e da palestra mencionadas, com pontos principais abordados. Em seguida, há um texto que escrevi sobre a "Doença de Alzheimer". Precisei estudar o assunto por interesse particular: o texto contém um registro deste estudo.Na sequência o livro traz: "Educação financeira", "Existência de Deus", "Compadrio político e STF", "Homem e liberdade, "Componentes na literatura", "Medicamentos e alimentos", "Criatividade", "Visão de futuro", "Aumento da inteligência", "Qualidade na educação superior", "Excelência docente", ..., "Vida científica". Ao todo são vinte temas. Vale o que escrevi na apresentação de outros livros: como os tópicos são selecionados, como os assuntos são tratados, por que abordei estes e não outros temas? Não há um padrão. A rigor, o único critério que utilizo para decidir escrever é me chamar atenção. O que está aspado abaixo foi extraído de outros livros, em que explico como os textos são escritos. "Procuro exercitar a concisão nos textos. É idiossincrasia do nosso tempo que as coisas sejam breves. Sigo este lema. Por isso, os casos são contados sem palavras desnecessárias. Eu até poderia prolongar aqui e ali, antes do desenlace. Mas não me concedo esta liberdade para cumprir o propósito da brevidade. Na escrita, fujo dos clichês, tento (não sei se consigo) pôr umas pitadas de literatura, buscando construções pouco usuais"."Em grande parte das vezes eu apenas proponho uma situação, sem extrair conclusões. This book addresses emerging questions concerning who should bear responsibility for shouldering risk, as well as the viability of existing and experimental governance mechanisms in connection with new technologies. Scholars from 14 jurisdictions unite their efforts in this edited collection to provide a comparative analysis of how various legal systems are tackling the challenges produced by the legal aspects of genetic testing in insurance and employment. They cover the diverse set of norms that surround this issue, and share insights into relevant international, regional and national incursions into the field. By doing so, the authors offer a basis for comparative reflection, including on whether transnational standard setting might be useful or necessary for the legal aspects of genetic testing as they relate to the insurance and employment contexts. The respective texts cover a broad range of topics, including the prevalence of genetic testing in the contexts of insurance and employment, and policy factors that might affect this prevalence, such as the design of national health or social insurance systems, of private insurance schemes or the availability of low-cost direct-to-consumer genetic testing. Further, the field of genetics is gaining in importance at the international and regional levels. Relevant concepts – mainly genetic tests and genetic data/information – have been internationally defined, and these definitions have influenced definitions adopted nationally. International law also recognizes a “special status” for human genetic data. The authors therefore also consider these definitions and the recognition of the special status of human genetic data within regional and national legal orders. They investigate the range of norms that specifically address the use of genetic testing in employment and insurance, encompassing international sources – including human rights norms – that may be binding or non-binding, as well national statutory, regulatory and soft-law mechanisms. Accordingly, some of the texts examine general frameworks relevant to genetic testing in each country, including those that stem from general anti-discrimination rules and norms protecting rights to autonomy, self-determination, confidentiality and privacy. In closing, the authors provide an overview of the efficiency of their respective legal regimes’ approaches – specific and generalist – to genetic testing or disclosure of genetic information in the employment or insurance contexts, including the effect of lack of legal guidance. In this regard, some of the authors highlight the need for transnational action in the field and make recommendation for future legal developments.

Politics and Kinship: A Reader offers a unique overview of the entanglement of these two categories in both theoretical debates and everyday practices. The two, despite many challenges, are often thought to have become separated during the process of modernisation. Tracing how this notion of separation becomes idealised and translated into various contexts, this book sheds light on its epistemological limitations. Combining otherwise-distinct lines of discussion within political anthropology and kinship studies, the selection of texts covers a broad range of intersecting topics that range from military strategy, DNA testing, and child fostering, to practices of kinning the state. Beginning with the study of politics, the first part of this volume looks at how its separation from kinship came to be considered a ‘modern’ phenomenon, with significant consequences. The second part starts from kinship, showing how it was made into a separate and apolitical field – an idea that would soon travel and be translated globally into policies. The third part turns to reproductions through various transmissions and future-making projects. Overall, the volume offers a fundamental critique of the epistemological separation of politics and kinship, and its shortcomings for teaching and research. Featuring contributions from a broad range of regional, temporal and theoretical backgrounds, it allows for critical engagement with knowledge production about the entanglement of politics and kinship. A presente obra argumenta a fundamentação jurídico-constitucional de um direito "novo", o direito à identidade genética do ser humano, surgido em decorrência do progresso tecnológico na área da Genética, que revelou a possibilidade fática de novas ameaças à vida, à integridade física e a outros bens jurídicos fundamentais. Apesar de não estar expressamente consagrado na Constituição de 1988, pode ser enquadrado no rol dos direitos materialmente fundamentais por meio do processo hermenêutico, fundamentado na natureza aberta da Constituição. O objeto de proteção do direito à identidade genética é o genoma humano, na sua dimensão privada, ou seja, a constituição genética individual, que se constitui do conjunto de 46 cromossomos contidos em cada célula do corpo humano, no interior dos quais existem as moléculas de DNA (ácido desoxirribonucléicos), cujos segmentos denominam-se genes e são responsáveis pela manifestação e transmissão de todas as características hereditárias normais e patológicas. A obra aborda ainda, os conflitos de direitos decorrentes da aplicação da análise do DNA genômico na investigação de paternidade (ou maternidade) e na prova criminal, dentre outros aspectos correlacionados.
