Unlike its Southeast Asian neighbors, Thailand was never colonized by an imperial power. However, Siam (as Thailand was called until 1939) shared a great deal in common with both colonized states and imperial powers: its sovereignty was qualified by imperial nations while domestically its leaders pursued European colonial strategies of juridical control in the Muslim south. The creation of family law and courts in that region and in Siam proper most clearly manifests Siam's dualistic position. Demonstrating the centrality of gender relations, law, and Siam's Malay Muslims to the history of modern Thailand, Subject Siam examines the structures and social history of jurisprudence to gain insight into Siam's unique position within Southeast Asian history. Tamara Loos elaborates on the processes of modernity through an in-depth study of hundreds of court cases involving polygyny, marriage, divorce, rape, and inheritance adjudicated between the 1850s and 1930s. Most important, this study of Siam offers a novel approach to the question of modernity precisely because Siam was not colonized yet was subject to transnational discourses and symbols of modernity. In Siam, Loos finds, the language of modernity was not associated with a foreign, colonial overlord, so it could be deployed both by elites who favored continuation of existing domestic hierarchies and by those advocating political and social change.

International Law is usually considered, at least initially, to be a unitary legal order that is not subject to different national approaches. Ex definition it should be an order that transcends the national, and one that merges national perspectives into a higher understanding of law. Several instances of war crimes trials are familiar to all scholars, but in order to advance understanding of the development of international criminal law, it is important to provide a full range of evidence from less-familiar trials. This book therefore provides an essential resource for a more comprehensive overview, uncovering and exploring some of the lesser-known war crimes trials that have taken place in a variety of contexts: international and domestic, northern and southern, historic and contemporary. It analyses these trials with a view to recognising institutional innovations, clarifying doctrinal debates, and identifying their general relevance to contemporary international criminal law. At the same time, the book recognises international criminal law's history of suppression or sublimation: What stories has the discipline refused to tell? What stories have been displaced by the ones it has told? Has international criminal law's framing or telling of these stories excluded other possibilities? This book offers an analysis of the decolonisation process across three different regions around the world: Central America, Southeast Asia and the Caucasus. It explores how the nature of previous imperial systems shaped the nation states that were created in their stead. By outlining these contrasting historical trajectories, this short study argues that the stability of these nation states and their ability to cooperate with one another are dependent on the acceptance of the frontiers established by the previous imperial powers. It moves from Central America, left in the early nineteenth century without any clear borders and which has suffered much inter-state tension ever since, to Southeast Asia, whose clear colonial delineations have been accepted in the post-colonial order, and finally to the Caucasus where the arbitrary boundaries of the Soviet Republics have not easily translated into nation states. Thomas Hobbes laid the theoretical groundwork of the nation-state in Leviathan, his tough-minded treatise of 1651. Leviathan 2.0 updates this classic account to explain how modern statehood took shape between the mid-nineteenth and mid-twentieth centuries, before it unraveled into the political uncertainty that persists today. Modern states were far from immune to the modernizing forces of war, technology, and ideology. From 1845 to 1880, the United States, Canada, Mexico, and Argentina were all reconstituted through territorial violence. Europe witnessed the unification of Germany and Italy, while Asian nations such as Japan tried to mitigate foreign incursions through state-building reforms. A global wave of revolution at the turn of the century pushed the modernization process further in China, Russia, Iran, and Ottoman Turkey. By the late 1930s, with the rise of the Soviet Union and Nazi Germany, the momentum of history seemed to shift toward war-glorifying totalitarian states. But several variants of the modern state survived World War II: the welfare states of Western democracies; single-party socialist governments; and governments dominated by the military, especially prevalent in Latin America, Asia, and the Middle East. Toward the end of the twentieth century, all of these forms stood in growing tension with the transformative influences of globalized capitalism. Modern statehood recreated itself in many ways, Charles S. Maier concludes, but finally had to adopt a precarious equilibrium with ever more powerful economic forces.
