Denn beim Recht kommt es fur Philosophie an auf die Prinzipien und auf den Nachweis, dass dieselben an Folge rungen fruchtbar sind. Ein Eingehen auf alles Detail fuhrt in die Aufgabe bald mehr des erklarenden Rechtshistorikers, bald mehr des Politikers. Obwohl mit der Moral zusammenhangend, musste die Rechtsphilosophie doch von ihr getrennt werden. Denn ihr eigenthumlicher Standpunkt ist, dass sie weder denen zustimmt, welche das Recht unmittelbar auf die Moral, jeder die seinige, grunden, noch denen, welche es von aller Moral trennen; sie streitet dafur, dass das Recht zwar eine mora lische Grundlage hat, aber eine mehr allgemeine, bei der sehr vieles offen gelassen ist, weshalb auch fur verschiedene Reli gionen und fur verschiedene Lebensansichten das Recht iden tisch sein kann.
