This volume comprises national reports on migration and migration law from 17 countries representing all continents. The vast majority of these are countries of immigration, which means they face specific challenges in terms of managing migratory flows that are increasingly linked with climate change and scarce natural resources worldwide, and they need to find viable ways to integrate humanitarian migration. Gegenstand der Arbeit ist das Kirchenasyl unter der Vereinbarung zwischen Bundesamt für Migration und Flüchtlinge (BAMF) und den christlichen Kirchen von 2015. Die wesentlichen rechtlichen und tatsächlichen Unterschiede zur Gewährung von Kirchenasyl seit Ende der 1980er Jahre werden herausgearbeitet und die Auswirkungen der BAMF-Kirchen-Vereinbarung und des daraufhin implementierten Dossierverfahrens auf die "Rechtsprobleme“ des Kirchenasyls analysiert. Damit kann beantwortet werden, ob es zu einer - bereits vor 30 Jahren befürchteten - Verrechtlichung des Kirchenasyls gekommen ist. Im Ergebnis lässt sich keine Verrechtlichung erkennen, wohl aber ein bisher unbekannter Grad an Formalisierung. Das staatlich zur Verfügung gestellte Härtefallverfahren für Flüchtlinge im Kirchenasyl schränkt die Legitimation etwaiger Sanktionen ein oder lässt sie ganz entfallen und verschiebt auch sonst die Begründungslasten. Dadurch kommt es zu neuen bzw. veränderten einfachrechtlichen Konsequenzen des Kirchenasyls.
