Governments and the business sector are increasingly recognising the potential of biodiversity products and services; markets which can help to promote the sustainable use and conservation of biodiversity. Some are already being profitably marketed, but private markets also need to be supported by appropriate public policies. This publication provides a conceptual framework to help identify and promote the use of markets in the biodiversity policy arena, and draws on the findings of a joint OECD/World Bank workshop held in Paris in January 2001. It discusses the concept of 'public goods' and considers four examples of emerging markets: organic agriculture; sustainable forestry; non-timber forest products, such as natural cosmetics and herbal medicines; and genetic resources.

Biodiversity losses continue at an alarming rate. Policies are therefore urgently needed to promote the sustainable use and conservation of biodiversity. Governments and private sector actors are increasingly recognising the potential of harnessing markets to help arrest the degradation of biodiversity. The private provision of biodiversity products and services is proving to be quite feasible in some circumstances. Some biodiversity products and services are already being profitably marketed. Private markets also need to be supported by appropriate public policies. This publication provides a conceptual framework for market creation in the biodiversity policy arena, as well as several examples of where the use of markets can assist policy makers and society at large in the search for more sustainable use and conservation of biodiversity.

The chapters in this volume provide insightful analysis and commentary on TRIPS and, importantly, the TRIPS Plus world that many countries operate in. . . This is a fine contribution to the growing literature of interdisciplinary analyses of the global IP regime. . . there is enough in here that makes the book worth acquiring and reading. Scholars of development more generally will find this book to be useful both for advancing their own understanding of the global IP regime and for integrating IP into broader development studies courses they teach. Kenneth C. Shadlen, Progress in Development Studies This book considers whether the WTO agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS) will become a vehicle for promoting greater international equity and engagement with the world economy or a tool for wealthy nations to extract excessive rents from poorer countries. Can TRIPS garner the necessary degree of legitimacy and public trust to deliver economic development? Can it become a key instrument for promoting international health and development? In response to these questions, the book proposes interpretive possibilities for the TRIPS text along with implementation strategies to avoid the threat of its irrelevancy due, amongst other things, to free trade agreements containing TRIPS-plus terms. The book discusses the impact of TRIPS from various perspectives, including those of developing countries. It will be of interest to informed citizens, members of NGOs and students and academics concerned with the debate about the impact of TRIPS on access to medicines at affordable prices, the protection of traditional knowledge, and the alleged neo-colonial effect of net revenue outflows from developing nations to developed nations for copyright and patent royalties.

ÔAn insightful guide to some key developments in the international governance of genetic resources. Exploration of the central role of state sovereignty in current approaches aids understanding of the impact that the socio-economic and political context has on the content and direction of rules in this area. The book includes extensive information on the influence of treaty regimes that are often marginal to or absent from other analyses of genetic resource governance (outer space, seas and oceans, and Antarctica).Õ Ð Catherine Rhodes, The University of Manchester, UK This detailed and concise book surveys the international genetic resources laws applying in Antarctica, space, the oceans and seas, the lands, and the airspaces above land and water. The well-structured analysis traces the evolution of these various schemes and their contributions to the comprehensive arrangements under the Convention on Biological Diversity, the International Treaty on Plant Genetic Resources for Food and Agriculture and the World Health OrganizationÕs PIP Framework. The book details the different avenues and concluded positions, documenting a laboratory of legal approaches and possibilities. Regulating Genetic Resources will be a valuable addition to academics, governments, NGOs and students in environmental and intellectual property law.
