This Report has been compiled so that lessons may be drawn for future referendums. On 18 September 2014, the Scottish public voted for Scotland to remain part of the United Kingdom. The roles played by civil servants in both Scotland and London in the Scottish referendum last summer were subject to criticism and controversy. The referendum campaign exposed two major issues: first, the question of how a unified Civil Service can serve both HM Government and the Scottish Government; and second, the challenges to Civil Service impartiality generated by the Scottish independence referendum. Particular concerns were raised about the Scottish Government's White Paper, Scotland's Future, which included a description of the SNP's proposed programme for government that was contingent upon their winning the 2016 Scottish Parliament elections. This did not uphold the factual standards expected of a UK Government White Paper and raised questions about the use of public money for partisan purposes. There was also concern that the publication of normally confidential advice by the Permanent Secretary to the Treasury called into question the impartiality of the Civil Service. The Committee concludes that parts of the White Paper should not have been included in a government publication. Civil servants should not be required to carry out ministers' wishes, if they are being asked to use public funds to promote the agenda of a political party, as was evident in this case.

The September 2014 Scottish independence referendum was an event of profound constitutional and political significance, not only for Scotland, but for the UK as a whole. Although Scottish voters chose to remain in the UK, the experience of the referendum and the subsequent political reaction to the 'No' vote that triggered significant reforms to the devolution settlement have fundamentally altered Scotland's position within the Union. The extraordinary success of the Scottish National Party at the 2015 General Election also indicates that the territorial dimension to UK constitutional politics is more prominent than ever, destabilising key assumptions about the location and exercise of constitutional authority within the UK. The political and constitutional implications of the referendum are still unfolding, and it is by no means certain that the Union will survive. Providing a systematic and academic analysis of the referendum and its aftermath, this interdisciplinary edited collection brings together public lawyers, political scientists, economists, and historians in an effort to look both backwards to, and forwards from, the referendum. The chapters evaluate the historical events leading up to the referendum, the referendum process, and the key issues arising from the referendum debate. They also explore the implications of the referendum both for the future governance of Scotland and for the UK's territorial constitution, drawing on comparative experience in order to understand how the constitution may evolve, and how the independence debate may play out in future.

As one of a small number of cross-government select committees, this Committee has gained a perspective on the state of Whitehall and its agencies which is not available to departmental select committees. Throughout the past five years, the recurring theme of their findings and recommendations reflects the importance of effective leadership in creating effective organisations. It is the positive or negative attitudes and behaviour in the people and the culture of an organisation which determines success or failure. Structures, processes and systems are important too, but preoccupation with these so often becomes a distraction from the real problems, which are about why people do not share information for the common good, collaborate effectively and trust one another. PASC took control of the process of selection of the Parliamentary and Health Service Ombudsman (PHSO) away from the Government altogether, so that for the first time Parliament has appointed its Ombudsman. They have also held many pre-appointment hearings for the Chairs of public bodies and were the first Select Committee to refuse to accept a government nomination for the chair of a public body. The Government was forced to re-run the selection for the post of Chair of the UK Statistics Authority under a new selection panel, and to propose a different candidate. They also hold hearings on PHSO's thematic reports, to interrogate and hold to account those who must respond to its recommendations. This book is concerned with the civil services of the United Kingdom, examining their characteristics and trends since 1970. It provides a map of the British civil service beyond Whitehall, giving an individual country-by-country analysis of the civil services of the UK. It considers the implications of the changing nature of the civil services for our understanding of British governance, especially in the context of the public sector management reforms of the 1980s and 1990s and the impact of constitutional change (chiefly devolution) since 1998. Given that devolution has been characterized as a process rather than an event, the book brings to bear evidence of how existing longstanding differences within some parts of British public administration may come to be replicated elsewhere in the UK. The authors also explore two controversial propositions. First they ask whether Britain is moving from the unitory, strong executive of the 'Westminster model' to a 'differentiated polity' characterized by institutional fragmentation. Second, they consider whether an unintended consequence of recent changes is a 'hollowing out of the state'. Is the British executive losing functions downwards to devolved governments and special-purpose bodies and outwards to regional offices and agencies with a resulting loss of central capacity? Substantial empirical data (both quantitative and qualitative) has been amassed here in order to give answers to these questions. Decentralizing the Civil Service assesses the UK's changing civil services in the wake of two decades of public sector management reforms and New Labour's constitutional reform programme, most notably devolution to Scotland, Wales and Northern Ireland. This assessment has significant implications for how we view governance in the UK.
