Otto Brunner contends that prevailing notions of medieval social and constitutional history had been shaped by the nineteenth-century nation state and its "liberal" order. Whereas a sharp distinction between the public and the private might be appropriate to descriptions of contemporary society, such a dichotomy could not be projected back onto the Middle Ages. Focusing particularly on forms of lordship in late medieval Austria, Brunner found neither a "state" in the modern sense nor any distinction between the public and private spheres. Behind the apparent disorder of late medieval political life, however, Brunner discovered a coherent legal and constitutional order rooted in the the rights and obligations of noble lordship. In carefully reconstructing this order, Brunner's study weaves together social, legal, constitutional, and intellectual history.

Gallus durch multis honoribus ac diviciis auszeichnet, dann hat er im 12. Jahrhundert die wirtschaftliche Blüte einer Abtei vor Augen, die ihren Besitz und Einfluß dem „Interesse und [...] Wohlwollen der alemannischen Bevölkerung“ verdankte, die sie „in gleichmäßiger Fortdauer“ vom 8. bis ins 10. Jahrhundert mit Schenkungen bedachte. Auch wenn für diese Zeit kein Urbar existiert, wenn die Mönche von St. Gallen überhaupt eines angelegt hatten, so sind dennoch für den Zeitraum bis 920 über 800 Urkunden – zumeist Traditionsurkunden – erhalten, welche ein „äußerst reichhaltiges, repräsentatives Material“ zur Dokumentation der Gütererwerbungen im Frühmittelalter darstellen. Schon der Blick auf die Traditionsformel in einer der ältesten Urkunden, die Wartmann auf ca. 700 datiert, zeigt, daß St. Gallen nicht nur „Grund und Boden“, sondern auch Hörige (mancipia) übertragen wurden, die „auf Grund und Boden sitzen und diesen Boden bebauen“, was den Kern der Definition von „Grundherrschaft“ im Sinne Otto Brunners bildet. Der Terminus „Grundherrschaft“ selbst als wissenschaftlicher Ordnungsbegriff für – wie es Kuchenbuch bezeichnet – die „ländlichen Herrschafts- und Appropriationsverhältnisse“ ist allerdings nicht den Quellen entnommen, sondern eine „zeitgebundene Begriffsschöpfung des 19. Jahrhunderts“, die schon bald eine Forschungskontroverse auslöste So sah sowohl Alfons Dopsch bereits unzureichend berücksichtigt, daß nicht der Grundbesitz allein die Herrschaftsrechte verlieh, sondern erst die adlige Standesqualität den Grundbesitzer zum Grundherrn werden ließ, als auch Walter Schlesinger zweifelte daran, Herrschaftsrechte aus der Verfügungsgewalt über Grund und Boden abzuleiten. Plädierten in der jüngeren Forschung Klaus Schreiner und Werner Rösener zwar für eine Beibehaltung des Fachterminus „Grundherrschaft“, um „ein vielschichtiges Sozialgebilde“ zu beschreiben, das wirtschaftliche, soziale und rechtliche Momente miteinander vernüpft, so schlug Peter Blickle jüngst wiederum vor, den historischen Ordnungsbegriff ganz durch den Quellenbegriff „Eigenschaft“ zu ersetzen.
