What does the concept of the best interests of the child mean in practice? How should it be interpreted and applied? This publication sheds lights on different aspects of this concept. The concept of the best interests of child, as stated in Article 3.1 of the United Nations Convention on the Rights of the Child, has caused many controversies and debates amongst policy makers, experts and practitioners. Although central to a child’s full enjoyment of his or her rights, the meaning of the concept in practice and how it should be interpreted and applied, is still part of today’s debate. The Belgian Authorities and the Council of Europe organised on 9 and 10 December 2014 a conference on “The best interests of the child - A dialogue between theory and practice” to provide an opportunity for actors involved in decisions that have an impact on children’s lives to share knowledge and enhance the understanding of the concept of the child’s best interest. Featuring in this publication are the 21 different viewpoints presented during the conference on the concept of the best interests of the child. They are divided into four chapters namely those presenting general reflections of the concept; assessing, determining and monitoring best interests; using the concept in different environments; and understanding the concept in family affairs. All viewpoints agree on the fact that there is no comprehensive definition of the concept, and that its vagueness has resulted in practical difficulties for those trying to apply it. Some suggest that the best interest should therefore only be used when necessary, appropriate and feasible for advancing children’s rights, whereas others see the flexibility of the concept as its strong point. Through their different interpretations and analysis, this publication offers a solid contribution to the overall understanding of the concept of the best interests of child, necessary to improving and safeguarding children’s rights overall.

Unaccompanied minor migrants are underage migrants, who for various reasons leave their country and are separated from their parents or legal/customary guardians. Some of them live entirely by themselves, while others join their relatives or other adults in a foreign country. The concept of the best interests of a child is widely applied in international, national legal documents and several guidelines and often pertains to unaccompanied minor migrants given that they are separated from parents, who are not able to exercise their basic parental responsibilities. This book takes an in-depth look at the issues surrounding the best interests of the child in relation to unaccompanied minor migrants drawing on social, legal and political sciences in order to understand children’s rights not only as a matter of positive law but mainly as a social practice depending on personal biographies, community histories and social relations of power. The book tackles the interpretation of the rights of the child and the best interests principle in the case of unaccompanied minor migrants in Europe at political, legal and practical levels. In its first part the book considers theoretical aspects of children’s rights and the best interests of the child in relation to unaccompanied minor migrants. Adopting a critical approach to the implementation of the Convention of Rights of a Child authors nevertheless confirm its relevance for protecting minor migrants’ rights in practice. Authors deconstruct power relations residing within the discourses of children’s rights and best interests, demonstrating that these rights are constructed and decided upon by those in power who make decisions on behalf of those who do not possess authority. Authors further on explore normative and methodological aspects of Article 3 of the Convention on the Rights of a Child and its relevance for asylum and migration legislation. The second part of the book goes on to examine the actual legal framework related to unaccompanied minor migrants and implementation of children’s’ rights and their best interests in the reception, protection, asylum and return procedures. The case studies are based on from the empirical research, on interviews with key experts and unaccompanied minor migrants in Austria, France, Slovenia and United Kingdom. Examining age assessment procedures, unaccompanied minors’ survivals strategies and their everyday life in reception centres the contributors point to the discrepancy between the states’ obligations to take the best interest of the child into account when dealing with unaccompanied minor migrants, and the lack of formal procedures of best interest determination in practice. The chapters expose weaknesses and failures of institutionalized systems in selected European countries in dealing with unaccompanied children and young people on the move.

De Raad van Europa heeft de richtsnoeren voor kindvriendelijke justitie en de bijbehorende toelichting vastgesteld in 2010. Ze zijn gebaseerd op bestaande internationale en Europese normen, met name het Verdrag van de Verenigde Naties inzake de rechten van het kind en het Europees Verdrag tot bescherming van de rechten van de mens, en ontworpen om de daadwerkelijke toegang van kinderen tot de rechter te waarborgen en een passende behandeling van kinderen in het justitiële apparaat te waarborgen. De richtsnoeren gelden voor alle omstandigheden waarin kinderen, om welke reden en in welke hoedanigheid dan ook, te maken kunnen krijgen met het stelsel van het strafrecht, burgerlijk recht of bestuursrecht. De beginselen van het belang van het kind, zorg en respect, participatie, gelijke behandeling en de rechtsstaat worden met deze richtsnoeren onderstreept en bevorderd. Aan bod komen kwesties als het recht van informatie, vertegenwoordiging en participatie, de bescherming van de persoonlijke levenssfeer, veiligheid, een multidisciplinaire aanpak en opleiding, waarborgen in alle stadia van de procedure en vrijheidsbeneming. De 47 lidstaten van de Raad van Europa worden aangespoord hun nationale rechtsstelsels aan te passen aan de specifieke behoeften van kinderen en de kloof te overbruggen tussen internationaal overeengekomen beginselen en de werkelijkheid. In dit verband worden in de toelichting voorbeelden gegeven van goede praktijken en oplossingen aangereikt voor bepaalde wettelijke en praktische tekortkomingen in justitie voor kinderen. Deze richtsnoeren vormen een integrerend onderdeel van de strategie van de Raad van Europa voor de rechten van het kind en van het programma „Bouwen aan een Europa voor en met kinderen“. In de lidstaten zijn promotie-, samenwerkings-en toezichtsactiviteiten gepland die ervoor moeten zorgen dat de richtsnoeren daadwerkelijk ten uitvoer worden gelegd, ten behoeve van alle kinderen.
