Het nieuw samengesteld gezin is een actueel, maar ook een historisch verschijnsel. In de loop van de geschiedenis werden tal van regels uitgevaardigd die zich tot doel stelden de verhoudingen binnen deze gezinnen te regelen. Ouders die weduwe of weduwnaar werden, gingen nieuwe huwelijken aan, vaak met partners die zelf kinderen hadden uit een eerder huwelijk. Tussen de belangen van alle betrokkenen diende een evenwicht te worden gevonden, voornamelijk met betrekking tot de nalatenschap van de eerst overleden ouder. In navolging van opeenvolgende maatschappelijke ontwikkelingen is het hedendaagse recht op dat punt in evolutie: wegens de hoge echtscheidingscijfers zijn er steeds meer nieuw samengestelde gezinnen, en bovendien in uiteenlopende vormen. Dit boek confronteert de ontwikkelingen in het positief recht met het oude recht. Hierbij schetsen rechtshistorici de context waarin de desbetreffende regels ontstonden, in verscheidene regio’s van continentaal West-Europa. Specialisten erfrecht en huwelijksvermogensrecht lichten het hedendaags geldende recht in België en Nederland toe, en belichten pijnpunten en mogelijk toekomstige ontwikkelingen. Dit boek bundelt de verslagteksten van het op 23 november 2012 georganiseerde colloquium rond het thema ‘Zakelijke rechten en erven in het nieuw samengesteld gezin, in heden en verleden’, waarop lezingen in drie talen werden gebracht. Deze studiedag ging uit van het Wetenschappelijk Comité Rechtsgeschiedenis van de Koninklijke Vlaamse Academie van België voor Wetenschappen en Schone Kunsten (KVAB) en werd mee mogelijk gemaakt dankzij de vakgroep Interdisciplinaire studies van het recht (JURI-DILS) en de vakgroep Privaat- en economisch recht (PREC) van de Faculteit Recht en Criminologie van de Vrije Universiteit Brussel (VUB). Dit colloquium herdacht de honderdste geboortedag van rechtshistoricus John Gilissen (1912), die aan de Vrije Universiteit Brussel politieke, institutionele en rechtsgeschiedenis doceerde.
