Financé par le Ministère de la Justice luxembourgeois, cet ouvrage représente la première synthèse de l'histoire de l'administration judiciaire au Luxembourg. Il est le fruit d'un travail de recherche et de documentation mené par la chercheure postdoc Vera Fritz et la doctorante Elisabeth Wingerter, sous la direction du professeur Denis Scuto, ainsi que d'études de différents spécialistes du droit et de son histoire. Par son analyse de l’évolution de l’organisation judiciaire de 1795 jusqu’à la réforme constitutionnelle des années 2000, l’ouvrage propose une contribution inédite à l’étude de la formation de l’Etat luxembourgeois. Au-delà des juridictions et de leur fonctionnement, il s’intéresse aussi à l’identité des magistrats et aux modalités de leur recrutement, la justice pénale et l’histoire des prisons, la justice en temps de guerre ainsi que l’impact du droit international et des juridictions européennes. Ses différentes contributions s’adressent aux historiens, juristes et professionnels du droit (personnel judiciaire, avocats, etc.), mais se veulent aussi accessibles au lecteur non-spécialisé.

Pour remplir les missions qui lui sont dévolues, la justice, de tout temps et en tout lieu, a d'abord été affaire d'hommes. Parmi les acteurs de la justice, le juge a une position privilégiée, mais il ne faut pas oublier les autres intervenants : avocats et procureurs, greffiers et huissiers, qui permettent à l'œuvre de juridiction de fonctionner. Il est utile de s'interroger sur le rôle de ces différents acteurs, sur leur fonction précise et le sens de leurs interventions. Il s'agit là d'une condition essentielle pour comprendre le fonctionnement effectif de la justice. Cette question a retenu l'attention de la Société d'histoire du droit et des institutions des pays flamands, picards et wallons, lors des Journées internationales d'histoire du droit et des institutions qui ont été organisées à Namur du 24 au 27 mai 2001, à l'invitation des Facultés universitaires Notre-Dame de la Paix. Ce volume reprend les actes du colloque. Il contient douze contributions de spécialistes de l'histoire du droit, centrées sur les Pays-Bas et couvrant une large période, qui s'étend du XIIe siècle au milieu du XIXe siècle. Ces études traitent de la justice échevinale, des magistrats des tribunaux civils, des avocats au Conseil de Flandre et des greffiers dans la justice criminelle sous l'Ancien Régime.
