Le genre humain reste toujours suspendue à elle. Le droit de la guerre en ce début de 3ème millénaire se trouve encore à l’état de droit coutumier et conventionnel, au même stade finalement que le droit public interne des sociétés antiques et tribales.

Le droit de la guerre au XVIIIème siècle caractérise un âge de transition dans l'histoire du droit international. Au début du XVIIIème, il est encore qualifié de " jus gentium " et n'est encore constitué que du " jus belli ", du droit de la guerre. La doctrine des Lumières va fonder le droit international moderne. Wolff, Burlamaqui, Vattel, Bynkershoek, Jean Jacob Moser, Gaspard de Real, Martens, Vicat, de Rayneval, Schmaltz et Klüber en seront les maîtres. Reste que le droit de la guerre lui même va être porté durant cette période à un niveau de technicité inégalé, résultat du travail doctrinal basé sur l'observation des usages des nations. Les conventions de guerre, les coutumes de la guerre, la neutralité seront avec les aspects théoriques de la juste cause et du juste prince parfaitement exposés.
