"Me preguntaba cuál es la forma más correcta de proceder para ser lo más fiel posible a la historia. Nadie puede creer en la emergencia de tantos personajes geniales que deben poco a su medio nutricio. Si Vázquez de Menchaca expuso ideas muy modernas, desde luego fuera de su época, esto le fue posible porque él era un jurista del Derecho Común que, además, dispuso para su formación de las obras de la Escuela de los Nominales. Vázquez sería impensable no sólo sin Bartolo de Sassoferrato, sino también al margen de Gerson o Biel. Lo mismo podemos decir de Francisco Suárez, Hugo Grocio o Samuel Pufendorf. Todos ellos se beneficiaron de la misma suerte que el Everest, que es la montaña más alta del mundo, pero sólo porque está en la cordillera del Himalaya. No fueron rompedores con lo que era su tradición, sino que dependieron del medio propio de su momento. Este fue un hecho especialmente patente en el siglo XVII, cuando Europa entera, como enfebrecida por la nueva idea del Derecho natural, concitó los esfuerzos de los universitarios para publicar Dissertationes, monografías y tratados del Jus naturale, en medio de muy fuertes polémicas. Ese fue el Himalaya sobre el que se alzaron las obras que conocemos hoy: fueron posibles por un cortejo de fuentes directas e indirectas que han quedado en el olvido. A partir de este momento, la expresión jus naturale necesita ser escrita con mayúscula, como Jus naturale, porque devino el nombre de una nueva disciplina o asignatura académica, la Juris Naturalis Disciplina".
