La consolidación de la pena privativa de libertad como pena típica de las sociedades contemporáneas, y la reforma penitenciaria por la que esta nueva penalidad se fue imponiendo en los ordenamientos jurídicos de los nuevos Estados de Derecho, fue probablemente uno de los proyectos más apasionados, esperanzadores y humanitarios de los que se acometieron a comienzos de la Edad Contemporánea. Esta obra pretende aportar una nueva perspectiva al estudio de la reforma penitenciaria española, desde sus antecedentes más inmediatos, a finales del Antiguo Régimen, hasta que la Guerra Civil española pusiera fin su impulso original a principios del siglo XX. A lo largo de sus páginas, se trata de indagar en los orígenes y el devenir histórico de reforma penitenciaria española, contextualizándola en el ámbito internacional, y aplicando fundamentalmente una metodología de estudio histórico-jurídica, a través del análisis de las principales doctrinas científicas que influyeron en su desarrollo y del espíritu de las leyes en las que se sustentó durante su largo recorrido. Isabel Ramos Vázquez es Profesora Titular de Historia del Derecho y de las Instituciones de la Universidad de Jaén. Doctora en Derecho (Universidad de Jaén, 2001), Doctora en Historia (Universidad de Educación a Distancia, 2013), una de sus principales líneas de investigación en los últimos tiempos ha sido la historia del derecho penal y penitenciario, con obras como Arrestos, cárceles y prisiones en los derechos históricos españoles, Premio Nacional de Investigación Victoria Kent 2007, Ministerio del Interior, Madrid, 2008, o La mujer en la cárcel: historia jurídica y políticas penitenciarias en España, XIV Premio Leonor Guzmán de la Diputación de Córdova y la Universidad de Córdoba, Córdoba, 2011.

Opening a new area in Latin American studies, The Birth of the Penitentiary in Latin America showcases the most recent historical outlooks on prison reform and criminology in the Latin American context. The essays in this collection shed new light on the discourse and practice of prison reform, the interpretive shifts induced by the spread of criminological science, and the links between them and competing discourses about class, race, nation, and gender. The book shows how the seemingly clear redemptive purpose of the penitentiary project was eventually contradicted by conflicting views about imprisonment, the pervasiveness of traditional forms of repression and control, and resistance from the lower classes. The essays are unified by their attempt to view the penitentiary (as well as the variety of representations conveyed by the different reform movements favoring its adoption) as an interpretive moment, revealing of the ideology, class fractures, and contradictory nature of modernity in Latin America. As such, the book should be of interest not only to scholars concerned with criminal justice history, but also to a wide range of readers interested in modernization, social identities, and the discursive articulation of social conflict. The collection also offers an up-to-date sampling of new historical approaches to the study of criminal justice history, illuminates crucial aspects of the Latin American modernization process, and contrasts the Latin American cases with the better known European and North American experiences with prison reform.

La Historia Social de las Instituciones Punitivas está necesitada en España de encuentro y debate, de confrontación y colaboración entre investigadores e investigadoras. Solo así logrará hacerse visible e inteligible como tendencia historiográfica y sobre todo como apuesta teórico-metodológica, porque de hecho ya es más que creíble como práctica historiográfica. El libro electrónico que aquí se presenta es una buena muestra de lo que allí se comunicó y discutió. Social History of Punitive Institutions in Spain needs meetings and discussions, comparison and collaboration between researchers. Only then it will become visible and intelligible as a historiographical trend and, above all, as a theoretical-methodological hope, because in fact, now it is more than conceivable as a historiographical practice. Here in this book are outlined, along with the achievements, the shortcomings and the most pressing challenges. Far from seeking an extemporaneous autonomy, Social History of Punitive Institutions wants to try to find its own feasibility based on intersections and good mixings. Those objectives were considered by the Study Group about History of Prison and Punitive Institutions (Grupo de Estudio sobre la Historia de la Prisión y las Instituciones Punitivas, GEHPIP) –an interuniversity team and with central office at Universidad de Castilla-La Mancha (UCLM)– when organising what it decided to name in an homonymous way 1st International Congress on History of Prison and Punitive Institutions (I Congreso Internacional sobre Historia de la Prisión y las Instituciones Punitivas), held in Ciudad Real (Spain) from 10 to 12 April 2013.
