This book examines how legal institutions reify the value of death in the twenty-first century. Its starting point is that bio-technological innovations have extended life to such an extent that death has become an epistemological problem for legal institutions. It explores how legal definitions of death are subject to the governing logic of economisation, how legal technologies for registering a death reshape what kind of deaths are counted during a pandemic, and how technologies for recycling cadaveric tissue problematise the legal status of the corpse. The question that unites each chapter is how legal institutions respond to technologies that bring death before their laws. The book argues for an interdisciplinary approach, informed by the writings of Georges Bataille, Wendy Brown, Georges Canguilhem and Michel Foucault, to understand how legal epistemologies are increasingly disrupted, challenged, and countered by technologies that repurpose death to extend, nourish and foster human life. Breaking one's dieting rule or resolution to quit smoking, procrastination, convenient lies, even the failure of entire nations to follow through with plans to cut greenhouse gas emissions or keep a pandemic in check - these phenomena have been discussed by philosophers and behavioural scientists as examples of weakness of will and delay discounting. Despite the common subject matter both fields have to date rarely worked together for mutual benefit. For the empirical literature is hardly accessible to a reader not familiar with econometric theory; and researchers in the behavioural sciences may find philosophical accounts invoking discounting models difficult to understand without inside knowledge of the debates and historical background. Nora Heinzelmann targets this lacuna by making the ideas and findings from both disciplines intelligible to outsiders. This reveals that discounting - as philosophers have conceived of it - is neither necessary nor sufficient for weakness of will, even though there is substantial overlap. Heinzelmann develops a richer descriptive account of weakness of will that is based on the empirically founded assumption that weak-willed behaviour is determined by uncertainty about whether or when a good materialises. She also explains why weakness of the will understood in this way is irrational: the agent yields to a cognitive bias that leads them to underestimate the greater good they think they ought to and can obtain. Finally, she explores practical implications for individuals and policymakers.

Rational choice theory forms the core of the economic approach to human behaviour. It is also the most influential philosophical account of practical rationality. Yet there are persistent controversies about the scope of rational choice theory in philosophy and, increasingly, in economics as well. A leading critic is the philosopher and Nobel Laureate economist Amartya Sen, who put forward a trenchant critique of rational choice theory in his seminal paper 'Rational Fools'. Sen emphasizes the importance of commitment - those aspects of human behavior which dispose individuals to co-operate, follow norms, and identify with others. He argues that rational choice theory cannot accommodate commitment, and demands a more adequate account of rationality. The question of how to account for the rationality of commitment is very much an open issue and, if anything, even more pressing today than when Sen first raised it. In Rationality and Commitment, thirteen leading philosophers and economists discuss Sen's claims and propose their own answers to the question of how to account for the rationality of committed action.
