O reconhecimento formal das uniões homoafetivas como entidades familiares, a partir do julgamento conjunto da ADI no 4277 e da ADPF no 132, em 2011, motivou o fortalecimento de outra reivindicação desses casais: o desejo de vivenciar a maternidade/paternidade, no seio da família, com a deflagração de todos os direitos e deveres inerentes ao parentesco. Dessa maneira, expõe-se, nesta obra, dentre as formas de concretização da homoparentalidade, a adoção e a reprodução humana assistida, evidenciando que a filiação passa, então, a ser identificada, sobretudo, pela presença do vínculo afetivo, sendo que se deve considerar a autonomia da vontade e a responsabilidade parental como elementos indispensáveis ao estabelecimento de vínculos jurídico-parentais. Além do preconceito e a polêmica que envolvem a paternidade/maternidade homoafetiva, um dos principais inconvenientes relacionados ao tema decorre das lacunas no ordenamento jurídico, que dificultam o exercício do direito à homoparentalidade dos casais homoafetivos. Por outro lado, a atuação do Poder Judiciário tem demonstrado um compromisso com a afirmação e concretização dos direitos homoafetivos, fixando importantes bases para o acesso destes aos direitos que lhes são inerentes enquanto cidadãos. A fotografia da família na pós-modernidade revela a valorização da individualidade humana, a adoção de instituições mais flexíveis, a valorização da inclusão e a busca pela formação integral e a realização pessoal plena de seus componentes.

Esta obra é fruto da pesquisa empírica sobre a legitimação da homoparentalidade pela adoção no Juizado da Infância e da Juventude Cível de Manaus, Estado do Amazonas, realizada no curso de Mestrado em Direito da Universidade La Salle Canoas/RS (UNILASALLE), que tem como área de concentração "Direito e Sociedade". Utilizando os dados fornecidos pelo Conselho Nacional de Justiça, pelo Sistema Nacional de Adoção e Acolhimento – SNA e pelo Juizado da Infância e da Juventude Cível de Manaus sobre o quantitativo de adoções homoparentais no período entre 01/01/2009 e 31/12/2020, bem como as decisões dos Tribunais Superiores relacionadas ao deferimento de adoção homoparental antes do reconhecimento da união entre pessoas do mesmo sexo como entidade familiar e uma década após o referido reconhecimento, a autora demonstra que ainda é pequeno o número de adoções por casais homoafetivas em relação aos casais heteroafetivos, bem como a incompatibilidade dos dados do Conselho Nacional de Justiça com os levantados no Juizado da Infância e da Juventude Cível de Manaus. Todavia, apesar da ausência de lei protetiva aos adotantes homoparentais, o Conselho Nacional de Justiça e o Juizado da Infância e da Juventude Cível de Manaus/AM vão em direção à proteção das pessoas que integram a comunidade LGBTQIA+, em conformidade com o estabelecido na Constituição Federal, no que tange à dignidade da pessoa humana e à igualdade de tratamento.
