Homophobia exists in many different forms across Europe. Member States offer uneven levels of legal protection for lesbian and gay rights; at the same time the social meanings and practices relating to homosexuality are culturally distinct and intersect in complex ways with gender, class and ethnicity in different national contexts. The essays in this volume illustrate the findings of a European project on homophobia and fundamental rights in which sociologists and legal experts have analysed the position in four Member States: Italy, Slovenia, Hungary and the UK. The first part of the book investigates the sociological dimensions of homophobia through qualitative methods involving both heterosexual and self-defined lesbian and gay respondents, including those in ethnic communities. The aim is to understand how homophobia and homosexuality are defined and experienced in the everyday life of participants. The second part is devoted to a legal analysis of how homophobia is reproduced 'in law' and how it is confronted 'with law'. The analysis examines statute and case law; 'soft law'; administrative practices; the discussion of bills within parliamentary committees; and decisions of public authorities. Among the areas discussed are 'hate crimes' and 'hate speech'; education at all levels; free movement, immigration and asylum; and cross-border reproductive services. In February 2012, Liberia became the latest African country seeking to pass new laws that would punish LGBT people. One bill currently before parliament would extend the criminal penalty for same-sex conduct by consenting adults to a second-degree felony punishable by up to five years in prison. A second bill would explicitly prohibit same-sex marriage. Liberia already makes same-sex conduct a criminal offense. Liberia has rarely enforced its existing anti-LGBT laws, and there is little evidence of people being prosecuted. Nonetheless, the existence of laws criminalizing sexual conduct exposes LGBT people to discrimination by public service providers, such as schools and hospitals, and encourages social stigmatization. The pending legislation makes life more difficult for LGBT people by reinforcing a widespread negative public perception of homosexuality in Liberia, intensifying everyday harassment that includes physical abuse and official discrimination. Based on 30 interviews with self-identifying lesbian, gay, bisexual, and transgender (LGBT) people in Liberia's capital, Monrovia, in September-December 2012, this report shows the harm caused by criminalizing same-sex conduct between consenting adults, and the impact that discrimination and homophobia has on the lives of LGBT people and their communities. The report urges Liberia's government to repeal existing laws criminalizing same-sex conduct among consenting adults and to reject new anti-LGBT legislation. It also calls for an end to discriminatory policies and practices against people based on sexual orientation, gender identity, and expression.

Homosexuality and the European Court of Human Rights is the first book-length study of the Court’s jurisprudence in respect of sexual orientation. It offers a socio-legal analysis of the substantial number of decisions and judgments of the Strasbourg organs on the wide range of complaints brought by gay men and lesbians under the European Convention on Human Rights. Providing a systematic analysis of Strasbourg case law since 1955 and examining decades of decisions that have hitherto remained obscure, the book considers the evolution of the Court’s interpretation of the Convention and how this has fashioned lesbian and gay rights in Europe. Going beyond doctrinal analysis by employing a nuanced sociological consideration of Strasbourg jurisprudence, Paul Johnson shows how the Court is a site at which homosexuality is both socially constructed and regulated. He argues that although the Convention is conceived as a ‘living instrument’ to be interpreted ‘in the light of present-day conditions’ the Court’s judgments have frequently forged and advanced new social conditions in respect of homosexuality. Johnson argues that the Court’s jurisprudence has an extra-legal importance because it provides an authoritative and powerful discursive resource that can be mobilized by lesbians and gay men to challenge homophobic and heteronormative social relations in contemporary societies. As such, the book considers how the Court’s interpretation of the Convention might be evolved in the future to better protect lesbian and gay rights and lives.
