The Admission and Integration of Refugees in Europe argues for a more interconnected understanding of laws and policies for the admission and integration of refugees and asylum seekers in the European Union. Admission and integration normally refer to different phases of the migratory process, but this demonstrates that they are inherently interconnected. Certain legal statuses conferred in admission procedures are directly relevant for the integration prospects of migrants, and the success or failure to integrate has potential repercussions for residence rights, although refugees are in that respect better protected than other immigrants. Legal pluralism further complicates the European context, as admission is often seen as under European Union jurisdiction, and integration as a Member State consideration. However, the book argues that this legal pluralism in fact helps us to better explain how interaction between admission and integration takes place across laws and legal orders. Combining broad conceptual and constitutional analysis with closer readings of specific policies and country-specific case studies, this book demonstrates the potential for specific admission policies to either promote or hinder integration. This book will be an important contribution to debates on European asylum and refugee law, human rights, and migrant integration policy.

This book provides a comprehensive assessment of the effectiveness of Mobility Partnerships and their consequences for third countries. Mobility partnerships between the EU and third countries are usually viewed as reflecting asymmetric power relations where development aid, trade relations and visa policies are made conditional upon the cooperation by third countries with an EU agenda of migration control. This book argues that three main factors condition the relevance of Mobility Partnerships: the state of relations between EU Member States and a third country, and in particular, the role of postcolonial ties; the power of negotiation of a third country, which is linked to its geopolitical importance for the EU; and its administrative capacity, which is understood as the capacity of a state to define and implement policies and to legislate and enforce the law. The work combines a comparative legal analysis of the development of the legal and policy frameworks in the cases of Morocco and Cape Verde with an empirical study of the implementation of Mobility Partnerships’ projects. The analysis demonstrates that Mobility Partnerships, despite their non-binding nature, have legal and policy relevance for these third countries with regard to the regulation of migration, asylum, human trafficking and even labour law. As such, this book makes a contribution to the understanding of the interplay between the interests of EU, Member State and third country actors in the implementation of the Mobility Partnerships. This book provides a critical analysis of irregular migration to Europe from a neo-Gramscian perspective. It demonstrates how the contemporary EU migration management regime came about within the context of a neoliberal hegemonic project, which in turn was advanced using neofunctionalist methods of integration. Relying on field research that was carried out in Bulgaria, Italy, Germany and Greece, the book also describes how European migration management is experienced by irregular migrants themselves. It suggests that the social purpose of migration management cannot be understood without assessing the experiences of the objects of migration regimes. The 2015 migration crisis revealed that large-scale migration has the potential to undermine some of the greatest achievements of the European integration project such as the Schengen system and open internal borders. This book shows that this fragility is the result of inherent contradictions within the neoliberal hegemonic project for the European Union. Under what circumstances can a state refuse refugee status to a person whose risk of persecution exists in only part of her country of origin? This book is the first monograph to examine the treaty basis and criteria for the ‘internal protection alternative’ (IPA), an exception to refugee status increasingly invoked by state parties to the 1951 Refugee Convention and its 1967 Protocol. Through a critical analysis of the relationship between refugee law and related fields, Schultz finds that the legal scope for IPA practice is narrower than is commonly claimed. Since persons subject to an IPA analysis have a well-founded fear of persecution within their countries of origin, any limit on their right to refugee status must involve a careful balancing of the impact of continued displacement against the state's interest in preserving its restricted protection resources. She argues that the doctrine of implied limits in human rights law can provide analytic structure to the IPA concept and reduce the risk of overly broad application.
