Based on a new data-set covering 29 European and neighboring countries, this volume shows how, Europeans view and evaluate democracy: what are their conceptions of democracy, how do they assess the quality of democracy in their own country, and to what extent do they consider their country's democracy as legitimate? The study shows that Europeans share a common view of liberal democracy, which is complemented by elements of social and direct democracy, which go beyond the basic liberal model. The level of their demands in terms of democracy varies, however, considerably across Europe and is related to their assessment of democracy: the worse the quality of democracy in a given country, the higher the respective demands on democracy. The analysis of the determinants of democratic views and evaluations shows that they depend on the political and economic (but less on the cultural) context conditions. This book provides a comprehensive analysis of the impact of populism on the European democratic polity. In the last two decades, European democracies have come under strain amid growing populism. By asserting the superiority of the majority over the law, of direct democracy over representation, and claiming the necessity to defend national sovereignty against foreign interferences, the populist conception of democracy is in stark contrast with the longstanding Western notion of liberal democracy. This volume investigates populist attempts to radically change what Bobbio called the “rules of the game” of democracy from an eminently legal perspective. Weaving together normative and empirical analysis, the contributions focus on the institutions that have suffered the most from the rise of populism as well as those that have better resisted the populist tide. Special attention will be paid to the Venice Commission’s opinions and documents, as they represent the best European standards to evaluate the extent to which populism deviates from constitutional democracy requirements. The book also considers the responses of European States to the explosion of the COVID-19 pandemic. The COVID-19 pandemic has indeed been an accelerator of known and studied trends in most constitutional systems, such as the concentration of powers in the executive hands and the consequential loss of parliament's centrality. Various forms of populism across Europe have thus found an ideal breeding ground to implement their agenda of granting the executive broad regulatory and decision-making powers while loosening parliamentary and judicial checks. Against this backdrop, the book analyses how European democracies should adapt to the challenges posed by the pandemic, as this reflection can help respond to populist threats and propose a way forward for liberal democracy.

Whereas ‘democracy’ assumes a single demos or people, ‘demoi-cracy’ refers to democratic government and governance in a polity constituted by separate peoples. Since the European Union consists of many demoi with different collective identities, largely separate public spheres, and a predominantly national political infrastructure, demoi-cracy is an appropriate standard for the analysis and evaluation of democracy in the EU. In its vertical dimension, demoi-cracy is based on the equality and interaction of citizens’ and statespeoples’ representatives in the making of common policies. Horizontally, it seeks to balance equal transnational rights of citizens with national policy-making autonomy. This volume offers exemplary studies exploring the potential for and the workings of demoi-cracy in the EU across a broad range of institutions and issues in both its vertical and horizontal dimensions. In particular, the contributions address the following questions: Is demoi-cracy relevant to citizen attitudes and public discourse on the EU’s legitimacy? How do national and supranational democratic institutions interact? Iceland and Ireland have turned to deliberative democracy to reform their constitutions. Estonia, Luxembourg and Romania have also experienced constitutional process in a deliberative mode, and in Belgium, a citizen-led initiative has fostered a wider societal debate about the role and place of citizens in the country's democracy. At the same time, European institutions have introduced different forms of deliberative democracy as a way to reinvolve citizens. These empirical cases are emblematic of a possibly constitutional turn in deliberative democracy in Europe.
