This book contains the proceedings of the conference “Comparative Data Law”, which was held in Munich in December 2023. The increasing relevance of data is now recognized all over the world. The large number of regulatory acts and proposals in the field of data law serves as a testament to the significance of data processing for the economies of the world. The European Union’s Data Strategy, the African Union’s Data Policy Framework and the Australian Data Strategy only serve as examples within a plethora of regulatory actions. Yet, the purposeful and sensible use of data does not only play a role in economic terms, e.g. regarding the welfare or competitiveness of economies. The implications for society and the common good are at least equally relevant. For instance, data processing is an integral part of modern research methodology and can thus help to address the problems the world is facing today, such as climate change. The conference was the third and final event of the Global Data Law Conference Series. Legal scholars from all over the world met, presented and exchanged their experiences on different data-related regulatory approaches. Various instruments and approaches to the regulation of data – personal or non-personal – were discussed, without losing sight of the global effects going hand-in-hand with different kinds of regulation. In compiling the conference proceedings, this book does not only aim at providing a critical and analytical assessment of the status quo of data law in different countries today, it also aims at providing a forward-looking perspective on the pressing issues of our time, such as: How to promote sensible data sharing and purposeful data governance? For 60 years the International Federation for Information Processing (IFIP) has been advancing research in Information and Communication Technology (ICT). This book looks into both past experiences and future perspectives using the core of IFIP's competence, its Technical Committees (TCs) and Working Groups (WGs). Soon after IFIP was founded, it established TCs and related WGs to foster the exchange and development of the scientific and technical aspects of information processing. IFIP TCs are as diverse as the different aspects of information processing, but they share the following aims: To establish and maintain liaison with national and international organizations with allied interests and to foster cooperative action, collaborative research, and information exchange. To identify subjects and priorities for research, to stimulate theoretical work on fundamental issues, and to foster fundamental research which will underpin future development. To provide a forum for professionals with a view to promoting the study, collection, exchange, and dissemination of ideas, information, and research findings and thereby to promote the state of the art. To seek and use the most effective ways of disseminating information about IFIP’s work including the organization of conferences, workshops and symposia and the timely production of relevant publications. To encourage communication and to promote interaction between users, practitioners, and researchers. To foster interdisciplinary work and – in particular – to collaborate with other Technical Committees and Working Groups. Although Europe has a significant legal data protection framework, built up around EU Directive 95/46/EC and the Charter of Fundamental Rights, the question of whether data protection and its legal framework are ‘in good health’ is increasingly being posed. Advanced technologies raise fundamental issues regarding key concepts of data protection. Falling storage prices, increasing chips performance, the fact that technology is becoming increasingly embedded and ubiquitous, the convergence of technologies and other technological developments are broadening the scope and possibilities of applications rapidly. Society however, is also changing, affecting the privacy and data protection landscape. The ‘demand’ for free services, security, convenience, governance, etc, changes the mindsets of all the stakeholders involved. Privacy is being proclaimed dead or at least worthy of dying by the captains of industry; governments and policy makers are having to manoeuvre between competing and incompatible aims; and citizens and customers are considered to be indifferent. In the year in which the plans for the revision of the Data Protection Directive will be revealed, the current volume brings together a number of chapters highlighting issues, describing and discussing practices, and offering conceptual analysis of core concepts within the domain of privacy and data protection. The book’s first part focuses on surveillance, profiling and prediction; the second on regulation, enforcement, and security; and the third on some of the fundamental concepts in the area of privacy and data protection. Reading the various chapters it appears that the ‘patient’ needs to be cured of quite some weak spots, illnesses and malformations. European data protection is at a turning point and the new challenges are not only accentuating the existing flaws and the anticipated difficulties, but also, more positively, the merits and the need for strong and accurate data protection practices and rules in Europe, and elsewhere.
