The Human Rights Of Older Persons written by Bridget Lewis and has been published by Springer Nature this book supported file pdf, txt, epub, kindle and other format this book has been release on 2020-08-07 with Law categories.

This book provides a comprehensive human rights analysis of key areas of law affecting older persons, including legal capacity; elder abuse; accommodation and aged care; healthcare; employment; financial security, retirement, and estate planning; and social and cultural participation. The research identifies individual autonomy and participation in decision-making as fundamental to a human rights-based approach to elder law. The book argues that a paradigm shift must occur away from traditional medical and charity-based understandings of ‘old age’ to instead acknowledge older persons as active holders of enforceable rights. The book argues that a Convention on the Rights of Older Persons is an essential tool in achieving this, but that even without a dedicated treaty there is much to be gained from a human rights-based approach. Significantly, because the issues arising in ‘old age’ are often the culmination of experiences occurring throughout the life course, a human rights-based approach to elder law must begin with a commitment to human rights for people of all ages.

This book promotes an understanding of ageism, discrimination and mistreatment of older adult workers, incorporating an international human rights perspective. The impact of ageism on the mistreatment of older adult workers has not to date been examined in depth through the lens of international human rights instruments, nor has discrimination against older adults in the workplace been framed as a form of elder abuse for research and policy making purposes. This book presents a multi-disciplinary exploration of these themes as they affect work and retirement of older adults. It reflects the view that older people who choose to work into old age should be able to do so in enabling work environments that promote dignity and are free of abuse. The contributing authors come from many disciplines, including law, psychology, social work, business, and international affairs. Many are members of the International Network for the Prevention of Elder Abuse (INPEA), a non-governmental organization with consultative status at the United Nations, and have devoted their professional careers to increase awareness and understanding of elder abuse in order to prevent it. The editors hope that broadening the framework within which elder abuse in the workplace is understood will stimulate further research, policy and program development to address this troubling social problem.

People are leading significantly longer lives than previous generations did, and the proportion of older people in the population is growing. Residential care for older people will become increasingly necessary as our society ages and, we will require more of it. At this moment in time, the rights of older people receive attention at international and regional levels, with the United Nations, the Organization of American States and the African Union exploring the possibility of establishing new conventions for the rights of older persons. This book explores the rights of older people and their quality of care once they are living in a care home, and considers how we can commence the journey towards a human rights framework to ensure decent and dignified care for older people. The book takes a comparative approach to present and future challenges facing the care home sector for older people in Africa (Kenya), the Arab world (Egypt), Australia, China, England, Israel, Japan and the USA. An international panel of experts have contributed chapters, identifying how their particular society cares for its older and oldest people, the extent to which demographic and economic change has placed their system under pressure and the role that residential elder care homes play in their culture. The book also explores the extent to which constitutional or other rights form a foundation to the regulatory and legislative structures to residential elder care and it examines the important concept of dignity. As a multi-regional study of the care of older person from a human rights perspective, this book will be of excellent use and interest, in particular to students and researchers of family and welfare law, long-term care, social policy, social work, human rights and elder law.

All over the world, there is a growing interest in the relationship between law and aging: How does the law influence the lives of older people? Can rights, advocacy and representation advance the social position of the aged and combat ageism? What are the new and cutting-edge frontiers in the field of elder law? Should there be a new international human rights convention in this field? These are only a few of the many questions that arise. This book attempts to answer some of these questions and to set the agenda for the future development of elder law across the globe. Taking into account existing research and knowledge, leading scholars from different continents (North America, Europe, Asia, and Australia) present in this book original and novel ideas regarding the future development of elder law. These ideas touch upon key topics such as elder guardianship, citizenship, mental capacity, elder abuse, human rights and international law, family relationships, age discrimination, and the right to die. This book can thus serve as an important reference work for all those interested in understanding where law and aging are headed, and for those concerned about the future legal rights of older persons.

Gender Issues In Elder Abuse written by Lynda Aitken and has been published by SAGE this book supported file pdf, txt, epub, kindle and other format this book has been release on 1996-10-17 with Political Science categories.

The ways in which gender is central to the occurrence, detection and prevention of elder abuse are analyzed in this volume. Drawing on their own research, the authors identify the gendered nature of elder abuse in the following areas: most of the very elderly victims are women; in both domestic and institutional settings, women abuse women; a significant number of older women are abused by their sons; a significant number of older men are abused by their female partners and daughters; and abuse by nonrelatives and noncarers of both sexes occurs. Gender Issues in Elder Abuse considers why much of the research on elder abuse has failed to engage with these facts. The authors call for a reframing of the issue of elder abuse, specifically in professional guidelines for dealing with abuse, which they insist, should include gender awareness. They argue for elder abuse to be considered as a human rights issue rather than a private problem.

The mistreatment of diverse older people in varying ways is categorized in many societies as “elder abuse and neglect,” yet this concept has not been subjected to rigorous critical inquiry. Instead, it has most often represented the interests of professionals, academics, and governments, while policy makers and researchers frequently disregard the complexity of issues that fall under the designation. The first comprehensive, scholarly critique of the topic, Contesting Elder Abuse and Neglect is an important, much-needed contribution that encourages new thinking, policies, and action regarding the treatment of older people.

The mistreatment of older people is increasingly recognised internationally as a significant abuse of elders’ human rights. ‘Scandals’ and inquiries into the failure to protect older people from abuse in health and social care systems rarely address, and still less challenge, the social, economic and cultural context to the abuse of older people. This critical and challenging book makes a strong case for the development of ethically-driven, research-informed policy and practice to safeguard older people from abuse. Drawing on findings of original UK research and framed in an international context, it illustrates ways in which ageism, under-resourced services to older people, target-driven health and social care policy and services, and organisational cultures of blame and scapegoating, are a powerful yet invisible backcloth to elder abuse. Safeguarding older people from abuse will be essential reading for policy makers, politicians, professionals, campaigners, researchers and educators, and those working in criminal justice fields.
