The persecution of people in Africa on the basis of their assumed or perceived homosexual orientation has received considerable coverage in the popular media in recent years. Gay-bashing by political and religious figures in Zimbabwe and Gambia; draconian new laws against lesbians and gays and their supporters in Malawi, Nigeria and Uganda; and the imprisonment and extortion of gay men in Senegal and Cameroon have all rightly sparked international condemnation. However, much of the analysis has been highly critical of African leadership and culture without considering local nuances, historical factors and external influences that are contributing to the problem. This statement is from one of the world’s most famous neurologist, Sigmund Freud, which developed psychoanalysis in 1935. Despite this statement it took 55 more years until the World Health Organisation (WHO) removed homosexuality from the list of mental disorders. Until 1993, homosexuality was classified as a harm of the body or mind, with the LGBT rights campaign still a young ‘discipline’, although achieving big successes in recent years. Nevertheless there is still a huge inequality between heterosexuals and LGBT peoples. Human rights in totality are more of a political issue than a legal issue. Only the collective understanding of human rights makes them universal, with citizens expecting their state to comply with them. This includes the rights of the LGBT peoples. Based on science a percentage, between 5 and 10 percent, of the human population identify as gay, this issue concerns between 350 to 700 million people. Not included are the estimated percentages of bisexual and transgender people, who also relate to these rights. Regardless of this it is surprisingly that the prosecution, discrimination and ostracism is not hidden, but rather operated in an open and partially aggressive way by religious communities, government bodies and individuals. This essay is going to answer firstly whether the LGBT rights could be classified as human rights. Secondly, there will be a discussion of the United Nation (UN) Declaration specifically the LGBT peoples. Thirdly, there is an overview of the global LGBT rights with particular focus on three selected countries: Uganda, Russia and South Africa, as these countries currently attract attention primary due to LGBT rights. Accordingly there is a critique and a conclusion.

There are countries where the situation is not as bad compared to others, which may be why people there assume that there are no human rights violations, but unfortunately, they can be found anywhere. One could choose any country in the world and focus on its human rights violations; it is always possible to find a shocking amount of information regardless of the country. In this seminar paper, I want to elucidate the human rights violations in a country that some people might not necessarily consider a negative example: South Africa. However, one of the fundamental problems with South Africa is that, to this day, the country has been unable to successfully fight its problems. These problems are numerous and cannot be fully explained in this short seminar paper, but it is important to have an overview of the whole situation, which is why I must recommend that people inform themselves about the ongoing situation and developments. In this paper, a quick overview shall be given of two very important issues in South Africa: race and sexual orientation. As everybody can imagine, South Africa’s situation today is still highly influenced by its past. The country struggles to reach racial reconciliation of its black and white people long after the Apartheid. The situation for LGBTQ (lesbian, gay, bisexual, transgender and queer) people is equally difficult since there is still a high proportion of South Africans who do not accept them and sometimes even violate their human rights in horrible and unimaginable ways. It is even more shocking to hear about these issues considering that South Africa has had a Constitution since the 1990s that should largely prevent discrimination and inequality. Section 9 of the Constitution’s Bill of Rights explicitly addresses the issues of race and sexual orientation, but, based on the ongoing, unresolved conflicts, its power is, in practice, limited. What are the reasons for all these human rights violations in South Africa? This paper was written in the context of the seminar “Human Rights Violations in Literature, Popular and Digital Cultures” of the Johannes Gutenberg University Mainz. In said seminar, we learned a lot about human rights violations all over the world, including those in countries where one would not expect them.

This book tells how South Africa came to lead the world in enshrining sexual equality in our Bill of Rights, which forms part of the Constitution. The achievement, which has been hailed as a model for the rest of the world, did not come about without a long struggle.
