This volume contains the papers which were presented at a symposium on human rights, held in September 1994 in Beijing and organized within the framework of an academic programme of co-operation between the Chinese Academy of Social Sciences and the Royal Netherlands Academy of Sciences. The focal point of most of the papers is the Vienna Declaration and Programme of Action - adopted during the 1993 Vienna World Conference on Human Rights - which, from the perspective of particularly the Chinese participants, is considered as marking a new beginning in the field of human rights. Taking the Vienna Declaration and Programme of Action as a point of departure the following main themes were the subject of discussion at the symposium and are more or less similarly reflected in the present volume: universality versus particularity; individual rights versus collective rights; national sovereignty and matters of international concern; ratification of international treaties.

Understanding and exercising the right to freedom of association, in a modern sense, is a relatively new phenomenon in China. The reform of ‘old’ social organizations and the emergence of new, privately-initiated, non-profit organizations only began to occur in the 1980s, and such organizations continued to expand throughout the 1990s. Within a short period these new organizations have become a vibrant force in Chinese society. This unique volume – the first book in English to offer systematic and critical research in this field - is the outcome of a three-year research project on the Legal Aspects of Social Organisations in China. The main aim of the project was to encourage Chinese researchers to deepen their knowledge and understanding of the current status of social organizations in China, and to allow them to explore possible ways of creating a friendly legal environment conducive to the exercise of the right to freedom of association. The book contains some of the best results of the Chinese researchers’ work and papers presented by European experts at two international seminars, organized jointly by the Institute of Law of Chinese Academy of Social Sciences and Law Faculty of Utrecht University, The Netherlands. Since the horrific Tiananmen Square massacre in 1989, the debate on human rights in China has raged on with increasing volume and shifting context, but little real progress. "Asian Values" is a concept advanced by some authoritarian regimes to differentiate an Asian model of development, supposedly based on Confucianism, from a Western model identified with individualism, liberal democracy, and human rights. Highlighting the philosophical development of Confucianism as well as the Chinese historical experience with community organization, constitutionalism, education, and women's rights, Wm. Theodore de Bary argues that while the Confucian sense of personhood differs in some respects from Western libertarian concepts of the individual, it is not incompatible with human rights, but could, rather, enhance them. De Bary also demonstrates that Confucian communitarianism has historically resisted state domination, and that human rights in China could be furthered by a genuine Confucian communitarianism that incorporates elements of Western civil society. "Prior to China's entry into the United Nations (UN) in 1971, there was fierce debate about its anticipated behavior and impact. Proponents of Chinese membership argued that integration into the United Nations would ultimately change or "civilize" the People's Republic of China (PRC) while skeptics countered that the "...the UN is not going to serve as a reform school for Peking," and that China was likely to attempt to alter the international system. When Chinese Communist Party (CCP) leaders failed to challenge the existing global order and eventually adjusted their own priorities and goals to fit into it and even benefit from the prevailing international order, its behavior alleviated concerns of destructive behavior. Yet, the larger question of China's longer-term impact on and role in international regimes remains an open question. Even if the PRC has not acted as a spoiler of the international system, are there subtle yet significant ways that it has pursued change toward international regimes?
