La trasformazione in corso del sistema internazionale, con il ridimensionamento di quello che viene definito l’Occidente ed il parallelo emergere di nuove potenze regionali sta spingendo i principali attori internazionali ad un rapido processo di adattamento, che però sempre più spesso risulta condizionato da crescenti vincoli economici e di bilancio. Soprattutto per gli Stati Uniti e per i paesi dell’Unione Europea, debito pubblico e vincoli di bilancio stanno esercitando un condizionamento sulle scelte di politica estera e di sicurezza. In particolare, dal 2010, l’Unione Europea ha dovuto investire una parte significativa delle proprie energie e risorse per affrontare la crisi del debito sovrano che ha investito alcuni paesi membri e minato la stessa stabilità della zona euro. La risposta alla crisi economica e finanziaria ha così distratto l’Unione dalle priorità di politica estera, proprio nel momento in cui la recente entrata in vigore del Trattato di Lisbona dotava finalmente l’Unione Europea di strumenti potenzialmente più adeguati per far fronte alle impegnative sfide del sistema internazionale, e in particolare delle aree limitrofe. Con questo volume L’Unione Europea: sicurezza, azione esterna, diplomazia, che nasce da un progetto di ricerca realizzato e finanziato dall’Istituto di Studi Politici “S. Pio V” si vuole dare un contributo alla riflessione strategica sulle prospettive, ambizioni e collocazione internazionale dell’Unione Europea alla luce dell’evoluzione del contesto internazionale, della crisi economica e delle nuove opportunità offerte dall'entrata in vigore del Trattato di Lisbona.

L’impiego di sanzioni di tipo ‘mirato’ o ‘intelligente’ ha caratterizzato l’azione del Consiglio di sicurezza delle Nazioni Unite nei primi due decenni del ventunesimo secolo. Un aspetto poco considerato riguarda l’esistenza di diverse stratificazioni di misure sanzionatorie rispetto ad una stessa situazione, in cui le organizzazioni regionali giocano un ruolo sempre crescente nel far fronte a minacce alla pace e alla sicurezza. L’interazione tra sanzioni a carattere universale e regionale si situa tra due poli: da un lato, una dinamica di tipo sussidiario, che vede le organizzazioni regionali come un prolungamento decentrato del sistema onusiano, dall’altro una dinamica di tipo competitivo, in cui non si escludono situazioni di tensione. Il libro, sulla base di una ricostruzione della prassi anche del continente africano, individua tre diversi modelli di relazione, a seconda che l’organizzazione regionale svolga un ruolo nella fase di attuazione delle sanzioni delle Nazioni Unite, oppure applichi contestualmente misure sanzionatorie nei confronti dei membri, oppure imponga misure restrittive nei confronti di terzi in assenza di un’azione da parte del Consiglio di sicurezza. Una ricognizione del dato normativo resta fondamentale sia per individuare quali siano gli strumenti giuridici dell’eventuale coordinamento tra l’ONU e le organizzazioni regionali, che non si limitano al Capitolo VIII della Carta, sia per verificare se vi sia stata un’evoluzione verso un approccio cooperativo rispetto alla tutela di interessi generali – come il mantenimento della pace e della sicurezza – nel senso anche dell’esistenza di una divisione del lavoro tra dimensione universale e regionale.

Il volume analizza la teoria dei «controlimiti» al primato del diritto dell’Unione europea alla luce delle evoluzioni che hanno caratterizzato il quadro normativo e giurisprudenziale comunitario negli ultimi decenni. La tematica oggetto d’indagine diventa l’asse problematico lungo il quale l’autore verifica «se» ed «in quale misura» il sistema di cooperazione giudiziaria basato sul meccanismo del rinvio pregiudiziale ex art. 267 TFUE possa consentire una rilettura del sindacato di costituzionalità sui controlimiti e, più in generale, agevolare la composizione dei conflitti interordinamentali. L’esame incrociato delle prospettive coinvolte permette di dimostrare l’esistenza di un dialogo tra le Corti d’Europa e di approfondire le tecniche decisorie impiegate dalle Corti costituzionali degli Stati membri quando gli elementi identificativi e irrinunciabili degli ordinamenti nazionali sono esposti a rischio di degradazione per effetto della preminenza del diritto sovranazionale. Così, la ricerca individua, caso per caso, il bilanciamento di valori effettuato a livello giurisprudenziale, ove la necessità di assicurare effettiva e uniforme applicazione del diritto dell’Unione europea è mitigata dall’esigenza di salvaguardare i principi costituzionali fondamentali degli Stati membri.
