The 2nd International Conference of Multidisciplinary Studies (ICMS) was held on July 12, 2023 in Semarang, Indonesia. Our theme was “Smart Technology and Creative Economy Transformation to Support Post-Pandemic Development”. We used a double-blind review to ensure the quality of papers. Reviewers were not allowed to know the identity of the authors. Contributions of the ICMS conference to academia and society are: 1. Building a network between universities in Asia, 2. This is an open access book.Adaptive, Resilient & Collaborative EngineeringTowards Faster Recovery & Impactful Solutions The world in the last decade has been facing global issues such as accelerated global warming, depleting natural resources, food waste and scarcity, water contamination and shortage, energy conservation, etc. Enter the COVID-19 pandemic in 2020 and we face what people term as double disruption. Not only solutions to the above problems are becoming more critical, but they are also needed fast. Timely and effective solutions are called for so that we can recover from the pandemic while at the same time carry our efforts to better our world. It is no longer sufficient to find solutions that can only delay the negative impacts from the above problems, but it is imperative to tip the balance and reverse the impacts to our advantage. Engineers and engineering have a vital role in inventing mechanisms, systems, and/or products that can address the solutions. Digital technologies and artificial intelligence have been at the forefront of such exploration and we can expect some hints for a better future, if we continue being adaptive, resilient, and collaborative. Given the above background, Faculty of Engineering - Universitas Surabaya, will host the fourth bi-annual international conference “The 4th International Conference on Informatics, Technology and Engineering 2023 (InCITE 2023)” in Yogyakarta, Indonesia, September 14th–15th, 2023. This event is a continuation of the past events successfully held in 2017, 2019, and 2021. We invite academia and business practitioners all around the globe to share ideas and best practices relevant to the above conference topic. We hope that this event can also serve as a platform of gathering for anyone interested in exploring potential solutions of our common problems today. Brazil has a very peculiar tax collection power distribution and revenue sharing system, that splits three way the consumption tax, giving taxation powers over goods circulation to the States, over services to the Municipalities and over production to the Union. The Brazilian State circulation of goods tax, whose regulations require unanimity to incentives and benefits concessions, even though the 27 Brazilian States development state are disparate, generates a "fiscal war" / State competition that costs 30 billion Brazilian Reais (6 billion Swiss Francs) yearly and the attempts at settling State Competition are clearly failing, while Switzerland, which has a similar political organization, seems to have a reasonable and functional system. This dissertation, requirement for the obtaining the title of Doctor in International Tax law, takes a case study approach to compare these two systems, specifically taxable events, financial transfer mechanisms and their rules to avoid State / Canton tax competition to assess if the Swiss system for tax collection power distribution and revenue sharing is a feasible solution to reduce the adverse effects of State tax competition in Brazil.

O presente livro é resultado de toda a pesquisa acadêmica realizada durante o curso de mestrado que concluí. De modo geral, o livro analisa as mudanças nos padrões de consumo da sociedade brasileira, estudando a relação entre tal fato e a necessidade de mudanças legislativas tributárias em vistas à inclusão social. Faz-se ainda um cotejamento entre os dados levantados e o sistema tributário posto, observando-se a efetividade, ou não, da aplicação da técnica da seletividade tributária em razão da essencialidade, sem a ocorrência de atualização temporal da legislação em relação aos produtos considerados essenciais atualmente. Toda a pesquisa desenvolve-se à luz da teoria de justiça como equidade de John Rawls, e convida o leitor a pensar o direito com um olhar além da legislação.

O livro mostra que a renúncia de receita de impostos vem, ao longo dos anos, propiciando aos setores de atividade, independentemente de seu tamanho, abrangência e ramo, condições para que empresas possam ampliar e valorizar seus capitais no mercado. Estimada em R$ 53,1 bilhões para 2022, a renúncia tributária, particularmente de ICMS, ao compensar a iniciativa privada dos riscos do desenvolvimento econômico, fazendo a sociedade participar também dos custos deste projeto, gera impacto financeiro nas contas públicas do governo do Estado. Essa renúncia seria justicável, do ponto de vista da sociedade em geral, caso estimulasse o desenvolvimento regional (homogeneização), econômico (geração de emprego e renda) e social (equidade). O autor escapa da narrativa de que a renúncia é condição sine qua non para formalização do mercado de trabalho, distribuição de renda e ampliação do investimento privado, retórica utilizada pelo lobby político e econômico para manter os privilégios fiscais. Devido a existência de poucos trabalhos publicados acerca do tema, quanto mais sob uma perspectiva crítica social, este livro é uma importante contribuição para as análises e estudos futuros da política de renúncia de receita tributária do Estado de São Paulo.
