Il commercio elettronico ha conosciuto un forte sviluppo ed è divenuto un'opportunità per la maggior parte delle realtà economiche in ragione di una serie di vantaggi che lo stesso comporta, sia sotto il profilo della diminuzione dei costi di struttura, sia per la possibilità di ampliare il mercato di riferimento. Tuttavia in queste dinamiche, in modo particolare negli ultimi anni, si sono rivelati necessari una serie di interventi normativi finalizzati ad equilibrare le posizioni economiche e contrattuali dei diversi soggetti coinvolti nelle transazioni, in particolare il fornitore della piattaforma (c.d. internet service provider o “marketplace”), l’operatore commerciale (o venditore) e l’acquirente (che spesso opera in qualità di consumatore). Ecco perché non possiamo che comprendere la forte attenzione dedicata dal legislatore europeo alla necessità di salvaguardare i diritti dei consumatori, la libertà di scelta, la libera concorrenza, la trasparenza delle transazioni, la tutela dei dati personali. Per tali motivi abbiamo assistito a una successione di atti normativi che hanno avuto come obiettivi principali l’introduzione di importanti tutele per la salvaguardia degli interessi innanzi richiamati, affiancate da strumenti concreti ed effettivi, e da cui derivano pesanti sanzioni in caso di violazione delle rispettive prescrizioni. Questo volume ripercorre tali ultimi interventi del legislatore nazionale e europeo incentrando però l’analisi sulle questioni pratiche e concrete che gli operatori del commercio online si trovano a dover affrontare al fine di progettare e gestire processi di vendita conformi alle regole del settore.
