Certo, la speciale qualificazione e la grande notorietà professionale e scientifica di tutti gli Autori del volume sarebbe di per sé motivo più che sufficiente per giustificare ed accreditare la felice iniziativa editoriale intelligentemente fatta propria da un Editore attento e particolarmente caro a chi scrive. Ma c’è anche dell’altro a rendere meritoria questa iniziativa, che ci mette a disposizione una nitidissima radiografia della tanto “famosa” legge di riforma.

La corruzione si manifesta in modi sempre più insidiosi e il legislatore continua a mettere in campo rimedi per contrastare questo fenomeno assai complesso. Nel 2012 la legge n. 190, per la prima volta, ha affrontato il tema della corruzione anche attraverso strumenti preventivi, diretti ad influire sulla stessa organizzazione della pubblica amministrazione. Tuttavia, è sul piano repressivo penale che il legislatore punta a contrastare l’illegalità amministrativa, un piano che oggi è occupato da un numero eccessivo di reati, che determina non poche difficoltà applicative. La legge n. 3 del 2019, nota come “spazzacorrotti”, da un lato, sembra aver compreso l’importanza di non considerare la corruzione come un fenomeno a cui rispondere solo con misure repressive, come dimostra l’introduzione dei nuovi istituti, dall’altro, però, sposta pericolosamente il baricentro in direzione della legislazione in materia di criminalità organizzata, confermando la preferenza per un approccio repressivo e di estremo rigore, che tuttavia non coglie la differenza tra i diversi fenomeni criminali. In aperta controtendenza si pone invece la recente e inaspettata riforma dell’abuso di ufficio (art. 23 del d.l. n. 76 del 2020, convertito dalla l. n. 120 del 2020), che riduce fortemente il campo applicativo del reato, realizzando un arretramento nel contrasto alla illegalità amministrativa. Il volume passa in rassegna queste due ultime riforme e sottopone ad una attenta analisi critica i nuovi istituti e le modifiche introdotte, tra cui, ad esempio, gli interventi su alcuni dei reati contro la pubblica amministrazione, le rilevanti novità sul regime delle pene accessorie, il nuovo fronte degli strumenti premiali e investigativi, la disciplina delle intercettazioni, senza trascurare di soffermarsi sulla riforma della prescrizione e sul tema, delicatissimo, del finanziamento dei partiti in Italia. Conclude l’analisi il capitolo sulla recente e discussa riforma dell’abuso di ufficio.

Corruption: A Study in Political Economy focuses on the problem of corruptions in political economy and functional bribery. This book is organized into four parts encompassing 11 chapters. Chapters 2 to 4 deal with the fundamental relationship among voters, legislators, and interest groups, as well as the role of the government bureaucracy in shaping legislative choices. Chapters 5 illustrates the basic relationships with an analysis of a monopolistic government official charged with allocating a benefit through a queuing system, while Chapter 6 retains the assumption of a single official with monopoly power but moves beyond the queuing model to consider alternative sanctioning strategies, a wider variety of bureaucratic tasks, and bribers who may be competitively or monopolisticly organized. Chapters 7 and 8 explore the potential of a system where officials are permitted to compete with one another in processing applications for governmental benefits. Under this system, an individual or firm rejected by one official can seek the benefit from other bureaucrats. Chapter 9 introduces a final administrative variable into the analysis, while Chapter 10 discusses the governmental corruption to analogous corrupt activities entirely within the private sector. Lastly, Chapter 11 looks into the relation between corruption and democratic theory, the possibility of reforming corrupt bureaucracies, and the link between economics and morality. This book will be of value to public servants, legislators, economists, sociologists, and researchers.
