La distinzione fra genere e sesso e emersa, anche se in modo spesso confuso e contraddittorio, in una recente polemica politico-ideologica, scaturita dalla possibilita concessa in molti Paesi occidentali a persone dello stesso genere di sposarsi o di unirsi civilmente. Tuttavia che il sesso non sia il genere e stato sempre chiaro dalla psicanalisi. Per Freud, per esempio, per assumersi una posizione nel sesso, bisogna aspettare non pochi anni, perche non solo non si diviene uomo o donna prima dell'adolescenza, ma soprattutto non si diviene ne uomo ne donna, quanto al sesso, in base a una determinazione biologica. A differenza del genere, il sesso dipende dalla relazione di un individuo con gli altri. Il maschile e il femminile seguono logiche diverse, ma ciascuno e libero di decidere di volta in volta quale seguire, del tutto a prescindere dall'anagrafe. Percio due persone dello stesso genere hanno lo stesso diritto di sposarsi che hanno sempre avuto quelle di genere diverso. Come, infatti, nulla garantisce che due persone di diverso genere siano anche e sempre di diverso sesso, cosi nulla esclude neppure che due persone dello stesso genere possano pure essere di diverso sesso. E quindi nulla impedisce nemmeno che due persone dello stesso genere (e di qualunque sesso) si sposino e adottino dei figli, per il semplice motivo che questo e sempre accaduto fra persone di genere diverso. La liberalizzazione del diritto di famiglia, che si sta realizzando in questi anni, spaventa solo quei "Grandi Inquisitori" che si sono sempre rifiutati d'ammettere che chiunque abbia il diritto e la capacita di scegliere, quando si assume il rischio delle proprie decisioni. Che oggi questa liberta venga riconosciuta anche rispetto al matrimonio costituisce un passo in avanti del tutto coerente con la nostra tradizione giuridica e civile, che ha da sempre affermato il diritto degli individui a scapito di quello dello Stato."
